【摘要】：近年來,我國非法互聯網體育博彩問題已經嚴重阻礙了福利事業(yè)和博彩產業(yè)的發(fā)展�；诖�,采用文獻綜述法和專家訪談法,就美國互聯網體育博彩法律規(guī)制問題進行了梳理和歸納。研究得出美國政府主要是從設備類型界定、跨境博彩問題判定、增設附加條款、設置地州獨立條款四個方面,來有效規(guī)制非法互聯網體彩行為。借鑒美國經驗,我國相關立法機構應該在形式形態(tài)上界定其非法活動對象、從地理空間上判定其非法行為、從特殊條款上適當放寬其合法業(yè)務,進一步完善互聯網體彩的法規(guī)內容。
[Abstract]:In recent years, the problem of illegal Internet sports betting has seriously hindered the development of welfare industry and gambling industry. Based on this, this paper, by means of literature review method and expert interview method, sorts out and summarizes the legal regulation of Internet sports betting in the United States. The research shows that the United States government mainly from the equipment type definition, cross-border gambling problem judgment, the addition of additional clauses, the setting of state independence clause, to effectively regulate illegal Internet sports lottery behavior. Drawing lessons from the experience of the United States, the relevant legislatures of our country should define the object of their illegal activities in the form of form, judge their illegal acts from the geographical space, and appropriately relax their legal business from the special terms. Further improve the Internet sports lottery laws and regulations.
