【摘要】：運動傷害會帶來法律評價上的損害賠償范圍確定與計算問題。作為學校體育開展的一個典型樣本,校園足球損害賠償范圍論對于認識學校體育傷害的賠償情況具有參照意義。對2012—2016年法院案件的實證研究考察顯示,校園足球損害賠償范圍的確定,需要在充分把握校園足球運動個性特征的基礎(chǔ)上,經(jīng)由一個彈性評價價值體系過濾,綜合考量個案多種影響因素后予以確定。在保險分擔風險機制不甚完善、學校過錯多發(fā)、精神損害賠償日趨普遍、損失分擔條款加重學校與加害人責任的背景下,損害賠償范圍論應(yīng)發(fā)揮"控制閥"的作用,有必要在一定程度上向被告方(特別是學校)傾斜,通過確立合理賠償而非全部賠償原則、限縮精神損害賠償范圍、引入因果關(guān)系聯(lián)系度、過錯程度、行為違法性程度、行為人年齡智力等考量因素,權(quán)衡主觀計算與客觀計算標準等方式,為學校開展校園足球運動減負。
[Abstract]:Sports injury will bring legal evaluation of the scope of damage compensation determination and calculation. As a typical sample of school sports development, the scope of campus football damage compensation theory has reference significance for understanding the compensation situation of school sports injury. An empirical study of court cases in 2012-2016 shows that the determination of the scope of campus football damage compensation needs to be filtered through an elastic evaluation value system on the basis of fully grasping the individual characteristics of campus football. Comprehensive consideration of the case of a variety of factors to determine. Under the background that the insurance risk sharing mechanism is not perfect, the school fault is frequent, the mental damage compensation is becoming more and more common, and the loss sharing clause intensifies the liability of the school and the offender, the scope of the damage compensation should play the role of "control valve". It is necessary to incline to a certain extent to the defendant (especially the school), by establishing the principle of reasonable compensation instead of all compensation, limiting the scope of compensation for mental damage, introducing the degree of causality connection, the degree of fault and the degree of illegality. In order to reduce the burden of school football, the factors such as the age and intelligence of the actor are considered, and the subjective and objective calculation criteria are weighed.
