【摘要】：對(duì)《歐洲足聯(lián)俱樂部財(cái)政公平法案》制定的緣由和歷程、目標(biāo)、審查時(shí)間和虧損限額、收入與支出的解釋、赦免原則、處罰方式與獎(jiǎng)勵(lì)條款進(jìn)行了梳理;以社會(huì)學(xué)家默頓的功能分析視角下,分析與評(píng)價(jià)了該法案頒布實(shí)施以來,財(cái)政層面、競(jìng)技層面和商業(yè)開發(fā)層面的顯在正功能、潛在正功能、顯在反功能和潛在反功能,并闡述了該法案對(duì)中國(guó)職業(yè)足球的啟示。在俱樂部經(jīng)營(yíng)層面,財(cái)政和經(jīng)營(yíng)狀況應(yīng)更加公開透明,重視服務(wù)球迷、人文關(guān)懷與社會(huì)擔(dān)當(dāng),自覺構(gòu)建以俱樂部為主體的青訓(xùn)體系;在制定政策法規(guī)層面,需注意法規(guī)的嚴(yán)謹(jǐn)論證與推出時(shí)間的合理性,以保證競(jìng)賽水平和服務(wù)質(zhì)量為政策制定的前提,引進(jìn)第三方審計(jì)、細(xì)化收入支出類別,限制與獎(jiǎng)勵(lì)性條款并行,尊重和保護(hù)投資人的熱情。
[Abstract]:The reasons and course of the formulation of the "European Football Association Club Fiscal Equity Act", the objectives, the review time and loss limits, the explanation of income and expenditure, the principle of pardon, the way of punishment and the terms of reward are combed in this paper. From the perspective of the sociologist Merton's functional analysis, this paper analyzes and evaluates the positive, potential, negative and potential functions of the financial, competitive and commercial development levels since the enactment and implementation of the Act. At the level of club management, the financial and business situation should be more open and transparent, attach importance to serving fans, humanistic care and social responsibility, consciously build a club as the main body of the youth training system; In formulating policies and regulations, we should pay attention to the strict demonstration of laws and regulations and the reasonableness of launch time, take the guarantee of competition level and service quality as the premise of policy formulation, introduce third-party auditing, and refine the income and expenditure categories. Restrictions go hand in hand with incentive provisions to respect and protect investor enthusiasm.
