【摘要】：目前,我國競技體育發(fā)展方興未艾,不僅展現(xiàn)我國綜合實力,提升國際形象,而且有助于民族凝聚力的提高。在競技體育不斷發(fā)展的過程中,商業(yè)化和市場化的融入對其產(chǎn)生一定的作用力,促使競技體育與經(jīng)濟(jì)產(chǎn)生了密切聯(lián)系。在利益的誘惑和驅(qū)動下,一些競技體育中的“黑暗行為”隨之產(chǎn)生,操縱比賽行為在這些問題中頗為顯著。當(dāng)下,對于我國競技體育中的操縱比賽行為來說,并沒有具體的法律規(guī)定和處罰條例對其進(jìn)行約束和治理,體育的基本法《體育法》中的相關(guān)規(guī)定也比較匱乏,有關(guān)體育問題的處罰大多是根據(jù)《刑法》中相關(guān)條例進(jìn)行引導(dǎo)性處罰。但由于體育的特殊性,刑法中現(xiàn)有的律條尚不能完全貼合實際的從根本上處理體育比賽中出現(xiàn)的情況,與問題實際解決的需求存在空隙。并且我國體育方面的賽制和管理體制也不夠完善,賽制不完善造成體育比賽進(jìn)行中有漏洞可鉆,管理體制中政管不分的現(xiàn)象給體育事業(yè)健康發(fā)展帶來隱患,這些問題的存在都可能造成操縱比賽行為的發(fā)生。而操縱比賽行為的出現(xiàn)給體育事業(yè)的發(fā)展帶來很大的阻礙,不僅是對體育精神的褻瀆,促使腐敗行為的發(fā)生,阻礙體育水平的提高,損害我國國家形象,同時也是對其他運動員以及觀眾不負(fù)責(zé)任,損害觀眾的利益。本文運用文獻(xiàn)資料法、比較研究法、案例分析法和理論分析法對我國競技體育操縱比賽行為進(jìn)行研究,得出如下結(jié)論:1.競技體育中操縱比賽行為具有行為人主觀故意性、主體特殊性、與比賽具有相關(guān)性、手段多樣性、實施項目集中性、出現(xiàn)廣泛性的特征。2.競技體育中操縱比賽行為的形成主要由社會因素、法律因素以及個人因素構(gòu)成。3.競技體育中操縱比賽行為的存在具有違背競技體育公平競爭原則、擾亂賽場秩序、阻礙競技體育市場化進(jìn)程、影響國家及相關(guān)單位形象、斷送運動員運動生涯、引發(fā)競技體育比賽安全隱患等危害。針對我國競技體育操縱比賽行為提出的相應(yīng)對策是:1.從健全法律法規(guī),完善管理體制方面來看,應(yīng)做到:完善立法,設(shè)立專門的體育法庭和管理機(jī)構(gòu);改善我國政企不分的管理現(xiàn)狀;完善博彩行業(yè);提升國民素質(zhì),將反腐進(jìn)行到底。2.從完善比賽賽制,提高體育從業(yè)人員職業(yè)素養(yǎng)方面來看,應(yīng)做到:在可能的項目上使用電子裁判;完善比賽賽制;在重視大型比賽的同時兼顧中小型比賽的治理;提高裁判員收入,高薪養(yǎng)廉;“體教結(jié)合”全面發(fā)展運動員,建立以競技體育從業(yè)者權(quán)益為本的社會保障體系;提升運動員和教練員的道德法律意識,加強(qiáng)業(yè)務(wù)學(xué)習(xí);把獎牌意識建立在民族榮譽(yù)和拼搏精神之后,調(diào)整金牌獎金額度。3.從建設(shè)與發(fā)展相結(jié)合方面來看,應(yīng)做到:平衡好國家、社會和市場經(jīng)濟(jì)對體育事業(yè)發(fā)展的宏觀調(diào)控和影響;全民體育、競技體育和體育產(chǎn)業(yè)協(xié)調(diào)發(fā)展;加強(qiáng)體育文化的宣傳和輿論的監(jiān)督。
[Abstract]:At present, the development of Chinese competitive sports not only show our country just unfolding, comprehensive strength, enhance the international image, but also helps to enhance national cohesion. In the process of development of competitive sports in the integration of business and marketization have a certain amount of force on the prompting of competitive sports and economic have close ties in the interests. The temptation and drive, some sports in the "dark behavior" arises, manipulation of the game behavior is significant in these problems. For the moment, our country athletics sports match fixing behavior, there is no specific legal provisions and penalties and constraints of its governance, the relevant provisions of the basic law of sports "the sports law is relatively scarce, the relevant problems of sports punishment are mostly guided punishment according to relevant regulations of the criminal law. But" because of the special nature of sports, the existing criminal law The law is still not fully fit the actual fundamental treatment appeared in sports, and solve practical problems. There is a gap in demand and China's sports competition system and management system is not perfect, imperfect competition caused by sports events in the loopholes in the management system of government management, regardless of the phenomenon for the healthy development of sports cause problems, these problems may be caused by the manipulation of the game behavior. And manipulate the game behavior brings great obstacles to the development of sports, sports is not only the spirit of blasphemy, prompting the occurrence of corruption, hinder physical level, damage the image of our country, at the same time but for the other athletes and spectators irresponsible, damage the interests of the audience. In this paper, using the method of literature, comparative research, case analysis and theoretical analysis to our country Sports match fixing behavior research, draws the following conclusion: the manipulation of the game behavior of 1. competitive sports has subjective intention, subject particularity, correlation and competition, means diversity, the implementation of the project focus, which manipulate the game behavior of comprehensive characteristics of.2. in competitive sports mainly by social factors, law the factors and personal factors which manipulate the game behavior in the presence of.3. in competitive sports competitive sports has violated the principle of fair competition, disrupt the competition order, hinder the process of competitive sports market, national and relevant units of image, career ruined athletes, competitive sports cause safety hazards. The corresponding countermeasures of our country athletics sports match fixing behavior this is the 1. from the perfect laws and regulations, improve the management system aspect, should perfect the legislation, the establishment of specialized sports The courts and administrative bodies; improve the management status quo of China's enterprises; improve the gaming industry; enhance the quality of the nation, the corruption in the end.2. from the perfect competition, improve the sports professional occupation accomplishment, it should be possible to use electronic cutting in project contracting; perfect competition; in the importance of taking into account the big game in the governance of small game; improve the referee income, high salary; combination of all-round development of athletes of physical education, to establish the competitive sports practitioners rights for the social security system; enhance the ethical and legal awareness of athletes and coaches, strengthen the business of learning; the establishment of national honor medal in consciousness and fighting spirit, adjust the amount of the bonus gold.3. from the construction and development of the combination of point of view, should balance the state, society and market economy macro-control on the development of sports industry and influence National sports, competitive sports and sports industry coordinated development; strengthen the publicity of sports culture and supervision of public opinion.
