【摘要】：歐盟是世界上體育活動(dòng)發(fā)展最為活躍的地區(qū)之一,歐盟的一體化發(fā)展策略也取得了巨大成功。在歐盟一體化進(jìn)程中其體育政策也隨之發(fā)展完善。通過(guò)查閱歐盟體育政策文本、歐盟官方網(wǎng)站、現(xiàn)有中外文研究資料,對(duì)歐洲體育管理的組織、結(jié)構(gòu)、體系、融資方式,歐盟體育管理組織機(jī)構(gòu),歐盟重要條約與體育之間的關(guān)系,歐盟體育的社會(huì)方面,歐盟體育的經(jīng)濟(jì)方面以及未來(lái)歐盟體育發(fā)展的戰(zhàn)略重點(diǎn)等幾個(gè)方面進(jìn)行了論證,梳理了在歐盟一體化視域下歐盟體育政策的發(fā)展。發(fā)現(xiàn)歐洲體育管理組織分為政府組織、非政府組織和其他組織。歐洲體育組織結(jié)構(gòu)呈自下而上的金字塔構(gòu)型。歐洲國(guó)家的體育政策體系類(lèi)型分為官僚性、企業(yè)型、使命型、社會(huì)型。歐洲國(guó)家的體育立法與融資方式不盡相同,但是歐洲國(guó)家趨向于給予體育國(guó)家層面上的資助。歐盟的組織機(jī)構(gòu)有歐盟部長(zhǎng)理事會(huì)、歐盟委員會(huì)、歐洲議會(huì)、歐洲法院。歐盟體育相關(guān)的重要條約有《歐共體條約》、《里斯本條約》、《歐盟體育白皮書(shū)》。歐盟體育政策主要包括青少年運(yùn)動(dòng)員保護(hù)、體育對(duì)外關(guān)系方面、打擊興奮劑、體育促進(jìn)民眾健康、體育在教育與訓(xùn)練方面的作用、志愿者服務(wù)和非盈利組織、體育的社會(huì)融入和社會(huì)對(duì)話(huà)、體育的環(huán)境保護(hù)、體育的財(cái)政資助、運(yùn)動(dòng)員的自由流通和國(guó)籍、體育經(jīng)紀(jì)人、職業(yè)體育轉(zhuǎn)播權(quán)、體育博彩業(yè)、體育無(wú)形資產(chǎn)的開(kāi)發(fā)與保護(hù)、體育稅收優(yōu)惠政策、錯(cuò)誤!未定義書(shū)簽。治理體育腐敗。未來(lái)歐盟體育政策發(fā)展戰(zhàn)略重點(diǎn)是健康、社會(huì)融入、教育與訓(xùn)練、反興奮劑、運(yùn)動(dòng)員職業(yè)生涯規(guī)劃、體育統(tǒng)計(jì)、可持續(xù)融資、競(jìng)爭(zhēng)法、國(guó)家援助、媒體權(quán)等。研究認(rèn)為:一、歐盟正視體育的重要性。歐盟委員會(huì)、歐盟部長(zhǎng)理事會(huì)、歐洲議會(huì)都有專(zhuān)門(mén)處理體育事務(wù)的機(jī)構(gòu),歐盟將體育相關(guān)內(nèi)容寫(xiě)入《里斯本條約》,歐盟的教育、健康、青少年培養(yǎng)基金往往給予體育以資助;二、歐盟體育政策日臻完善�！稓W盟體育白皮書(shū)》從社會(huì)、經(jīng)濟(jì)、組織機(jī)構(gòu)、后續(xù)發(fā)展幾方面規(guī)劃了歐盟未來(lái)體育發(fā)展的藍(lán)圖,以此為基礎(chǔ),歐盟針對(duì)體育相關(guān)問(wèn)題出臺(tái)了許多政策文件;三、奉行一體化政策的歐盟在國(guó)際體育組織的話(huà)語(yǔ)權(quán)遠(yuǎn)大于單個(gè)國(guó)家。國(guó)際足聯(lián)不得不根據(jù)歐盟運(yùn)動(dòng)員自由流通規(guī)定修改轉(zhuǎn)會(huì)規(guī)則;四、歐盟尊重體育的特殊性。在體育相關(guān)案例中,歐洲法院遵循逐案審查原則,關(guān)于體育在歐盟法的適用方面,歐盟認(rèn)為體育不同于其他社會(huì)活動(dòng),應(yīng)當(dāng)充分考慮到體育的特殊性。對(duì)我國(guó)的啟迪是:一、在國(guó)際化背景下完善我國(guó)體育體制與政策法規(guī);二、轉(zhuǎn)變體育發(fā)展模式,完成由“體育大國(guó)”向“體育強(qiáng)國(guó)”的轉(zhuǎn)變;三、構(gòu)思我國(guó)區(qū)域體育一體化發(fā)展規(guī)劃。
[Abstract]:The European Union is one of the regions with the most active development of sports activities in the world. The integration development strategy of the EU has also made great success. In the process of EU integration, its sports policy has also developed and perfected. Through consulting the text of EU sports policy, the official website of the EU has been obtained. Existing Chinese and foreign language research materials, European sports management organization, structure, system, financing methods, the EU sports management organization, the relationship between the EU important treaties and sports, the social aspects of EU sports. The economic aspects of EU sports and the strategic focus of EU sports development in the future are discussed. Combing the development of EU sports policy from the perspective of EU integration, it is found that European sports management organizations are divided into government organizations. Non-government organizations and other organizations. The structure of European sports organizations presents a bottom-up pyramid structure. The sports policy system of European countries can be classified into bureaucratic, enterprise and mission type. Social type. European countries' sports legislation and financing methods are different, but European countries tend to give sports national level of funding. The European Union has the Council of Ministers of the European Union, the European Commission. The European Parliament, the European Court of Justice, the important treaties relating to EU sports include the Treaty of EC, the Treaty of Lisbon, the White Paper of EU Sports. The EU sports policy mainly includes the protection of young athletes. In terms of sports external relations, the fight against stimulants, the role of sport in promoting public health, the role of sports in education and training, volunteer services and non-profit organizations, social integration of sports and social dialogue. Sports environmental protection, sports financial support, free circulation and nationality of athletes, sports brokers, professional sports broadcasting rights, sports gambling, sports intangible assets development and protection, sports tax preferential policies. Wrong! The future EU sports policy development strategy focuses on health, social integration, education and training, anti-doping, athletes career planning, sports statistics, sustainable financing. Competition law, state aid, media rights and so on. The study holds that: first, the EU faces the importance of sports. The European Commission, the Council of Ministers of the EU, and the European Parliament all have specialized bodies dealing with sports affairs. The EU includes sports in the Treaty of Lisbon, and the EU funds for education, health and youth development are often used to fund sports. Second, EU sports policy is becoming more and more perfect. The White Paper of EU Sports plans the blueprint for the future development of EU sports from the aspects of society, economy, organization and subsequent development. The EU has issued many policy documents on sport-related issues; Third, the European Union, which pursues the integration policy, has far greater voice power in international sports organizations than in individual countries. FIFA has to amend the transfer rules according to the rules of free circulation of EU athletes; Fourthly, the EU respects the particularity of sports. In sport-related cases, the European Court of Justice follows the principle of case by case review. As for the application of sports in EU law, the EU believes that sports are different from other social activities. We should take the particularity of sports into full consideration. The enlightenment to our country is as follows: first, to perfect our sports system and policies and regulations under the background of internationalization; Second, change the development mode of sports, complete the transformation from "sports big country" to "sports powerful country"; Third, conceive our country area sports integration development plan.
