【摘要】：近來,學生傷害事故的發(fā)生和處理頻繁見報,成為了社會關注的熱點問題。又有研究表明體育課上發(fā)生的事故占據了整個學校學生傷害事故的主要部分,而且所占的比例有逐年遞增的趨勢,但就我國已頒布的法律來說,對此類事故中各方責任的認定尚不明確,對事故的處理亦缺乏具體的規(guī)定,導致在此類事故中法律的可操作性不強,爭議也頗多,這些都不利于學校體育的健康發(fā)展。這種狀況的出現主要是由于我國有關學校體育傷害事故的立法研究起步較晚、立法意識較為薄弱造成的,它還直接的影響到事故處理的公平性和合法性。在司法實踐中學校傷害事故的處理需要成熟的法律作為導向,所以需要我國學校體育傷害事故的立法進一步系統(tǒng)和完善,因此,對于學校體育傷害事故中的焦點問題進行探討、研究,即有利于保護事故中當事人即學校、教師、家長、學生的合法權益,更有利于學校體育的蓬勃發(fā)展。本文運用案例分析、邏輯推理分析、專家訪談和文獻資料等方法,首先簡述了體育教學、學校體育傷害事故的概念,繼而分析了對體育傷害事故研究的兩性,同時又簡單的敘述了高校體育教學中學生傷害事故產生的原因及特點和事故處理的法律依據及范圍,進而在基本理論已然明晰的基礎上對學校法律上的地位、權利和義務、學校在事故中需盡的注意義務和其與學生之間的關系進行了刨析,最后在洞悉了基本理論和基本關系的前提下對事故中責任的分類以及歸責原則的適用做了一定的分析。希望能以此為我國在體育事故中立法的理論探索奉獻微薄之力。
[Abstract]:Recently, the frequent occurrence and treatment of student injury accidents has become a hot issue of social concern. Some studies show that accidents in physical education class occupy the main part of the whole school students injury accidents. And the proportion of the increasing trend year by year, but the law has been promulgated in our country, the identification of the responsibility of the parties in such accidents is not clear, the handling of the accident is also lack of specific provisions. As a result of this kind of accidents, the operability of the law is not strong, and there are many disputes. These are not conducive to the healthy development of school sports. This situation is mainly due to the late start of legislation on school sports injury accidents, legislative awareness is relatively weak. It also directly affects the fairness and legality of accident handling. In judicial practice, the treatment of school injury accident needs mature law as the guidance. Therefore, it is necessary to improve the legislation of school sports injury accident in our country. Therefore, the focus of the school sports injury accident is discussed and studied, that is to say, it is beneficial to protect the parties in the accident, that is, the school. The legitimate rights and interests of teachers, parents and students are more conducive to the vigorous development of school physical education. This paper uses the methods of case analysis, logical reasoning analysis, expert interviews and literature, etc. The concept of school sports injury accident, and then analyzed the gender of sports injury accident research. At the same time, it simply describes the causes and characteristics of the injury accidents of the students in physical education teaching in colleges and universities, and the legal basis and scope of dealing with the accidents, and then, on the basis of the clear basic theory, the legal status of the school. The rights and obligations, the school's duty of care in the accident and the relationship between the school and the students were analyzed. Finally, on the premise of understanding the basic theory and the basic relationship, the author makes a certain analysis on the classification of responsibility in accidents and the application of the principle of imputation. It is hoped that this will contribute to the theoretical exploration of legislation in sports accidents in our country. Power.
