【摘要】：美國現(xiàn)代法學教育與法理學的形成和發(fā)展,在相當程度上,是與其現(xiàn)代法學院的建構和發(fā)展緊密相關的;在一定意義上,美國本土法理學是美國社會對法律之現(xiàn)實需求的實用性智識回應,而法學院則在這一智識回應過程中發(fā)揮著不可或缺的功用。隨著現(xiàn)代法學教育的重心從哥倫比亞大學向哈佛、耶魯、芝加哥等大學法學院的順次移轉,美國現(xiàn)代法理學也先后經(jīng)歷了蘭德爾式的法律科學傳統(tǒng)、法律現(xiàn)實主義、法律研究的政策科學視角、過程法理學以及法律與經(jīng)濟學等交叉學科法理學研究的發(fā)展演進過程,從而形成了一個獨具美國特色的現(xiàn)代法理學譜系。
[Abstract]:The formation and development of modern law education and jurisprudence in the United States, to a certain extent, are closely related to the construction and development of its modern law school. American native jurisprudence is the practical intellectual response of American society to the practical need of law, and law school plays an indispensable role in the process of this intellectual response. With the shift of modern law education from Columbia University to Harvard, Yale, Chicago and other law schools, modern jurisprudence in the United States has experienced Randall's tradition of legal science and legal realism. From the perspective of policy science, process jurisprudence and law and economics, a modern jurisprudence pedigree with American characteristics has been formed.
