治理視角下我國(guó)大學(xué)教授委員會(huì)權(quán)力運(yùn)行機(jī)制研究

【摘要】:教授委員會(huì)為我國(guó)高等教育管理體制改革注入了新思路與新內(nèi)涵,它提倡以學(xué)術(shù)為重,崇尚大學(xué)自治與學(xué)術(shù)自由的大學(xué)氛圍,,其興衰直接關(guān)系大學(xué)未來發(fā)展方向。教授委員會(huì)制度作為一項(xiàng)制度創(chuàng)新,在高校發(fā)揮著深化學(xué)校體制改革和建立現(xiàn)代大學(xué)制度的雙重作用。建立教授委員會(huì)制度,不僅是協(xié)調(diào)高校內(nèi)部學(xué)術(shù)權(quán)力和行政權(quán)力發(fā)展的有效途徑,同時(shí)也是高校堅(jiān)持以人為本、保障學(xué)術(shù)權(quán)力能夠被充分行使以及促進(jìn)學(xué)術(shù)發(fā)展的客觀要求。 但現(xiàn)實(shí)中,教授委員會(huì)的權(quán)力被行政組織壓制,并沒有實(shí)現(xiàn)其設(shè)立的初衷——去行政化和彰顯學(xué)術(shù)權(quán)力,甚至在某種程度上成為行政組織的附庸,發(fā)揮不了實(shí)際功效。而正是由于其運(yùn)行缺乏必要的法律法規(guī)保障、結(jié)構(gòu)紊亂,學(xué)術(shù)集權(quán)現(xiàn)象嚴(yán)重、教授委員會(huì)職責(zé)關(guān)系模糊等一系列問題的存在,使教授委員會(huì)在高校的實(shí)際運(yùn)行過程中,會(huì)出現(xiàn)權(quán)力失衡,運(yùn)作形式化等一系列的問題。治理,強(qiáng)調(diào)的是治理主體和手段的多元化,強(qiáng)調(diào)上下互動(dòng),其權(quán)力運(yùn)行向度是多元的;治理的核心就是分權(quán)、參與。由此可以看出,治理的內(nèi)涵更符合教授委員會(huì)制度的精神本質(zhì),體現(xiàn)了大學(xué)的分權(quán)、參與與制衡的原則。因此,本文從治理的角度為教授委員會(huì)權(quán)力運(yùn)行機(jī)制的研究提供了一個(gè)新的研究視角。 本研究借鑒美國(guó)和德國(guó)大學(xué)評(píng)議會(huì)發(fā)展模式,綜合我國(guó)當(dāng)前特殊的國(guó)情以及校情,因地制宜地去探索符合我國(guó)高校發(fā)展的教授委員會(huì)的權(quán)力類型,分析運(yùn)行機(jī)制存在的問題以及制定完善的路徑。這個(gè)道路慢且長(zhǎng)。本文由導(dǎo)言及四個(gè)部分組成: 第一部分:對(duì)治理的基本內(nèi)涵及其基本特征的概述。本部分從國(guó)內(nèi)現(xiàn)有的資料和理論分析入手,通過文獻(xiàn)分析法對(duì)治理的核心概念:分權(quán)、參與進(jìn)行梳理;以治理的基本特征、治理結(jié)構(gòu)及治理模式作為分析與研究的基礎(chǔ),并在此基礎(chǔ)上得出對(duì)本研究的啟示。 第二部分:治理視角下大學(xué)教授委員會(huì)權(quán)力類型、結(jié)構(gòu)及運(yùn)行機(jī)制。本部分首先梳理了教授委員會(huì)的權(quán)力類型,主要包括二元權(quán)力滲透、學(xué)術(shù)權(quán)力主導(dǎo)型;二元權(quán)力滲透、行政權(quán)力主導(dǎo)型;二元權(quán)力分離、適度滲透型;其次是分析教授委員會(huì)的權(quán)力結(jié)構(gòu);最后是分析教授委員會(huì)權(quán)力運(yùn)行機(jī)制的類型:主要包括決策機(jī)制、執(zhí)行機(jī)制、監(jiān)督制約機(jī)制三種。本部分通過對(duì)教授委員會(huì)權(quán)力類型、權(quán)力結(jié)構(gòu)和運(yùn)行機(jī)制進(jìn)行分析,結(jié)合治理的結(jié)構(gòu)和治理模式,綜合治理的內(nèi)涵,為探索教授委員會(huì)運(yùn)行機(jī)制及存在的問題奠定基礎(chǔ)。 第三部分:當(dāng)前我國(guó)部分大學(xué)對(duì)教授委員會(huì)權(quán)力運(yùn)行機(jī)制的探索。本部分以東北師范大學(xué)、吉林大學(xué)和武漢大學(xué)三所大學(xué)為代表。通過對(duì)這三所大學(xué)的院系負(fù)責(zé)人和部分專業(yè)任課教師進(jìn)行深度訪談和問卷調(diào)查、以及對(duì)大學(xué)生進(jìn)行訪談,對(duì)教授委員會(huì)的章程、權(quán)力、運(yùn)行機(jī)制等方面進(jìn)行分析,透析大學(xué)教授委員會(huì)權(quán)力運(yùn)行機(jī)制存在的問題,并對(duì)存在的問題進(jìn)行了深入分析。 第四部分:我國(guó)大學(xué)教授委員會(huì)權(quán)力運(yùn)行機(jī)制的完善路徑。本部分結(jié)合治理的內(nèi)涵:分權(quán)、參與,借鑒東北師范大學(xué)、吉林大學(xué)、武漢大學(xué)和美國(guó)、德國(guó)大學(xué)評(píng)議會(huì)的成功經(jīng)驗(yàn),針對(duì)教授委員會(huì)權(quán)力運(yùn)行機(jī)制存在的問題:如缺乏必要的法律法規(guī)、結(jié)構(gòu)紊亂、權(quán)力失衡等,提出具體的完善策略。
[Abstract]:The professor committee has injected new ideas and new connotations for the reform of the management system of higher education in China. It advocates the academic atmosphere, advocating the University atmosphere of university autonomy and academic freedom. The rise and fall of the university is directly related to the future direction of the University. As a new system, the professor committee system is playing an important role in deepening the reform and construction of the school system in Colleges and universities. The establishment of the system of the modern university system is not only an effective way to coordinate the development of academic power and administrative power in Colleges and universities, but also the requirement of adhering to the people-oriented, guaranteeing the full exercise of academic power and promoting academic development.
But in reality, the power of the professor committee is suppressed by the administrative organization and does not realize the original intention of its establishment - to admin and highlight the academic power, even to a certain extent, to become the appendage of the administrative organization. It is because of its lack of necessary laws and regulations, structural disorders, and academic centralization. Serious, the existence of a series of problems, such as the ambiguity of the responsibilities of the professor committee, causes a series of problems, such as the imbalance of power and the formalization of operation, in the course of the practical operation of colleges and universities. The heart is the separation of power and participation. Thus, it can be seen that the connotation of governance is more in line with the spiritual essence of the professor committee system and embodies the principle of decentralization, participation and checks and balances in the University. Therefore, this article provides a new perspective for the study of the mechanism of the power operation of the professor committee from the angle of governance.
This study draws on the development model of the United States and German universities, combines the current special national conditions and the school situation in our country, and explores the power types of the professors committee that conforms to the development of our universities, analyzes the problems existing in the operation mechanism and formulating the perfect path.
