【摘要】：隨著我國教育市場化體制改革的推進,高校產(chǎn)權(quán)問題業(yè)已成為教育體制改革和發(fā)展的重要命題。然而,由于非營利性高校產(chǎn)權(quán)的"非營利性",加上公辦高校的"政資不分"與"政校不分"以及民辦高校的"出資者控制"等問題,造成我國非營利性高校法人所有權(quán)處于"虛置"和"缺失"的狀態(tài),引發(fā)了諸如高校法人主體地位難以實現(xiàn)、高校法人產(chǎn)權(quán)缺失法律保護、高校產(chǎn)權(quán)的激勵約束功能失效等一系列的問題。對此,高校需要確立高校法人對學(xué)校財產(chǎn)的所有權(quán),健全和完善高校法人所有權(quán)的共同治理機制,貫徹落實高校法人的主體地位和自主權(quán)利。

However, due to the "non-profit" of the property rights of non-profit colleges and universities, together with the problems of "political resources" and "political schools" in public colleges and universities, as well as the "control of funders" in private colleges and universities, and so on, As a result, the ownership of legal person in non-profit universities in our country is in the state of "false place" and "missing", which leads to the difficulty of realizing the subject status of legal person in colleges and universities, and the lack of legal protection of property rights of legal persons in There are a series of problems such as the failure of incentive and restraint function of property rights in colleges and universities.
