【摘要】：通過對38所"985工程"大學(xué)的章程進(jìn)行文本分析,發(fā)現(xiàn)我國大學(xué)章程在學(xué)生權(quán)利的明確上存在表述多樣化、內(nèi)容相似的特征,依據(jù)教育類法律規(guī)定的受教育權(quán)主體法定權(quán)利是大學(xué)章程明確的學(xué)生權(quán)利的主要組成部分,依據(jù)非教育類法律規(guī)定的其他主體身份法定權(quán)利則是補(bǔ)充組成部分�，F(xiàn)行大學(xué)章程中明確的學(xué)生權(quán)利內(nèi)容具有其合法性與合理性,同時亦存在不足之處,包括兜底條款表述不嚴(yán)謹(jǐn),以及大學(xué)資源總量與學(xué)生權(quán)益之間不平衡。大學(xué)章程在明確本校學(xué)生權(quán)利時應(yīng)以其上位法及相關(guān)規(guī)范性文件提供的規(guī)則為基本準(zhǔn)則,并以大學(xué)各自所擁有的資源總量與其謀求的福祉收益的平衡為其限度。
[Abstract]:Through the text analysis of the articles of association of 38 "985 engineering" universities, it is found that the university charter of our country has the characteristics of diversity and similarity in the explicit expression of students' rights. The legal right of the subject of the right to education according to the law of education is the main component of the students' rights defined in the articles of association of the university, and the legal right of the other subjects according to the law of non-education is the supplementary part. The explicit content of student rights in the current university charter has its legitimacy and rationality, but there are also some shortcomings, including the unrigorous expression of the bottom clause, and the imbalance between the total amount of university resources and the rights and interests of students. The university charter should be based on the rules provided by its superior law and relevant normative documents, and the balance between the total amount of resources owned by the university and the benefit of its welfare should be taken as its limit when clarifying the rights of its students.
