【摘要】：大學(xué)生實(shí)習(xí)與雇主形成的關(guān)系與雇傭關(guān)系類似,但又不完全一致。我國(guó)保護(hù)大學(xué)生實(shí)習(xí)權(quán)益的法律法規(guī)還不完善。美國(guó)聯(lián)邦勞工部和法院發(fā)布了一系列識(shí)別不受法律規(guī)范的無(wú)薪實(shí)習(xí)標(biāo)準(zhǔn),以此界定出受最低工資法案保護(hù)的大學(xué)生實(shí)習(xí)。紐約州在相應(yīng)的法律中專門(mén)界定了無(wú)薪實(shí)習(xí)的其他權(quán)益保護(hù)范疇和措施。英國(guó)根據(jù)現(xiàn)有的就業(yè)類別,對(duì)不同類別的實(shí)習(xí)生賦予不同的權(quán)益。美英兩國(guó)規(guī)范實(shí)習(xí)生權(quán)益的法理,對(duì)實(shí)習(xí)生分類,區(qū)分實(shí)習(xí)生的基本權(quán)益和其他權(quán)益等做法對(duì)中國(guó)具有借鑒性。
[Abstract]:The relationship between practice and employer is similar to that of employment, but it is not completely consistent. The laws and regulations to protect the rights and interests of college students are not perfect in our country. The Federal Department of Labor and the courts have issued a series of standards that identify unpaid internships that are not regulated by the law, defining college internships protected by the minimum wage Act. New York State specifically defines the scope and measures of other rights protection for unpaid internships in its corresponding laws. Different types of interns are given different rights and interests in the UK according to the existing categories of employment. The legal principles of regulating the rights and interests of interns in the United States and Britain, the classification of interns, the distinction between the basic rights and interests of interns and other rights and interests, can be used for reference in China.
