【摘要】："雙一流"建設(shè)的提出,進(jìn)一步突破了以往政府在大學(xué)管理活動(dòng)中一面獨(dú)大的固化格局,呈現(xiàn)出"政-校"共治模式;政府對(duì)資源控制的絕對(duì)化得以改觀,辦學(xué)經(jīng)費(fèi)撥款呈現(xiàn)多方參與格局;第三方參與保障了大學(xué)動(dòng)態(tài)化管理的可行性,政府與大學(xué)間呈現(xiàn)出多維關(guān)聯(lián)的特殊性。與此同時(shí),"雙一流"建設(shè)亦充斥著政府行政管理權(quán)、教育統(tǒng)籌權(quán)與大學(xué)辦學(xué)自主權(quán)、學(xué)術(shù)自由權(quán)之間權(quán)利關(guān)系的矛盾統(tǒng)一性。要處理好"雙一流"建設(shè)中政府與大學(xué)之間的關(guān)系,須以法厘清二者間的權(quán)利邊界、以理性民主規(guī)約二者間的合理權(quán)限、以多方共治保障二者間的權(quán)利融洽。
[Abstract]:The proposal of "double first-class" construction has further broken through the solidified pattern of government's dominance in university management activities in the past, and presented the "political-school" co-administration mode, and the government's absolute control of resources has been changed. The third party participation ensures the feasibility of the dynamic management of the university and the particularity of the multi-dimension connection between the government and the university. At the same time, the construction of "double first-class" is also filled with the contradiction and unity of the right relationship between the government administration, the right to coordinate education, the autonomy of running a university, and the right to academic freedom. In order to deal with the relationship between the government and the university in the construction of "double first-class", we must clarify the right boundary between them by means of law, regulate the reasonable authority between them by rational democracy, and guarantee the harmony of the rights between them by co-governing in many ways.
