論我國公立高校教師職稱評審權(quán)的公法規(guī)制

【摘要】:當(dāng)前,在高等教育領(lǐng)域"放管服"改革逐步深化的宏觀政策引導(dǎo)下,政府對公立高校教師職稱評審的"審批式管理"開始被"質(zhì)量導(dǎo)向"的"監(jiān)管式治理"取代。據(jù)此,公立高校教師職稱評審權(quán)的行政規(guī)制,正在由"顯性"轉(zhuǎn)向"隱性"。然而,這并未改變公立高校教師的職稱評審權(quán)作為行政權(quán)的現(xiàn)實窘境,政府依舊將公立高校教師職稱評審視為國家"委辦事項"。要破解我國公立高校教師職稱評審權(quán)規(guī)范與保障的一系列難題,必須走出將其界定為"內(nèi)部管理權(quán)"抑或"行政權(quán)"的誤區(qū)。從理想的狀態(tài)而言,公立高校教師職稱評審權(quán)應(yīng)回歸作為學(xué)術(shù)自治權(quán)的本質(zhì)并被納入公法規(guī)制的視野,進(jìn)而形塑"國家法"與"大學(xué)法"良性互動的"合作規(guī)制"結(jié)構(gòu)。
[Abstract]:At present, under the guidance of the macro policy of deepening the reform in the field of higher education, the "examination and approval management" of teachers' professional titles in public universities is beginning to be replaced by "quality oriented" regulatory governance ". Accordingly, the administrative regulation of teachers' professional title evaluation right in public universities is changing from "overt" to "recessive". However, this does not change the reality of the administrative power of the public university teachers' professional title evaluation power. The government still regards the public university teachers' professional title evaluation as a national "appointment matter". In order to solve a series of difficult problems in the regulation and guarantee of teachers' professional title evaluation right in public colleges and universities, we must go out of the misunderstanding of defining it as "internal management power" or "administrative power". From the ideal state, the evaluation right of teachers' titles in public colleges and universities should return to the essence of academic autonomy and be brought into the vision of public law regulation, thus shaping the "cooperative regulation" structure of "national law" and "university law".
