【摘要】：美國聯(lián)邦最高法院在2016年"費希爾案"中對公立高校積極差別待遇錄取政策的司法審查呈現(xiàn)出新的動向,包括規(guī)制司法遵從邊界,嚴(yán)格緊密縮限標(biāo)準(zhǔn),定性闡釋臨界規(guī)模內(nèi)涵。積極差別待遇錄取政策能夠促進高等教育機會實質(zhì)平等,有效緩和社會矛盾沖突。同時,該類政策的制定實施需不斷精細(xì)完善,確保獲益群體定向準(zhǔn)確。
[Abstract]:In Fisher's case in 2016, the Federal Supreme Court of the United States showed a new trend in the judicial review of the admission policy of positive differential treatment in public colleges and universities, including the regulation of judicial compliance boundaries, strict and tight limitation standards, and qualitative interpretation of the connotation of critical scale.The admission policy of positive differential treatment can promote the substantive equality of opportunities in higher education and effectively alleviate the social contradictions and conflicts.At the same time, the formulation and implementation of such policies need to be refined to ensure that the benefit group orientation is accurate.
