【摘要】:在法治中國背景下,法治成為建設(shè)和諧社會的重要前提。隨著大學(xué)生遭受就業(yè)侵權(quán)問題日益凸顯,促使大學(xué)生就業(yè)走上法制化道路,是未來的發(fā)展趨勢。大學(xué)生是我國未來建設(shè)的中堅力量,維護他們的就業(yè)權(quán)益,對促進大學(xué)生法律素質(zhì)的有效轉(zhuǎn)化、提升大學(xué)生依法就業(yè)與維權(quán)能力、增強思想政治教育的實踐性、構(gòu)建平等法治和諧的勞動力市場都有著重要的意義。因此,深入解讀大學(xué)生就業(yè)維權(quán)意識的內(nèi)涵,探索大學(xué)生就業(yè)維權(quán)意識培育的路徑,如何以就業(yè)結(jié)合法,以法促就業(yè)維權(quán),是當(dāng)前高校思想政治教育面臨的一項重要課題。本研究在系統(tǒng)綜述了國內(nèi)外有關(guān)大學(xué)生就業(yè)維權(quán)方面的研究基礎(chǔ)上,運用文獻資料法、問卷調(diào)查法和統(tǒng)計分析法等,以馬克思主義理論和思想政治教育學(xué)原理為指導(dǎo),實證結(jié)合理論地展開論述。本研究主要分為以下四個部分:第一個部分:一是以闡述研究背景和意義為起點,綜述國內(nèi)外的有關(guān)研究成果,明確論文的研究思路和方法;二是介紹大學(xué)生就業(yè)維權(quán)的主要內(nèi)容,厘清"大學(xué)生就業(yè)"、"大學(xué)生就業(yè)維權(quán)意識"及"大學(xué)生就業(yè)維權(quán)意識培育"的內(nèi)涵。第二個部分:一是結(jié)合馬克思主義關(guān)于人的全面發(fā)展理論、人的價值理論、權(quán)利義務(wù)理論、我國法律法規(guī)政策文件的規(guī)定,指出大學(xué)生就業(yè)維權(quán)意識培育的依據(jù);二是強調(diào)大學(xué)生就業(yè)維權(quán)意識培育的重要性,它可以促進大學(xué)生法律素質(zhì)的有效轉(zhuǎn)化,提升大學(xué)生依法就業(yè)與維權(quán)能力,增強思想政治教育實踐性,構(gòu)建平等法治和諧的勞動力市場。第三個部分:一是為了進一步了解大學(xué)生就業(yè)維權(quán)意識的現(xiàn)狀,制定了針對即將畢業(yè)或面臨畢業(yè)大學(xué)生的調(diào)查問卷,包含就業(yè)維權(quán)認(rèn)知、情感、行為、教育四個維度,發(fā)現(xiàn)了大學(xué)生就業(yè)維權(quán)意識存在就業(yè)法律法規(guī)知識了解程度低、就業(yè)維權(quán)的救濟渠道不順暢、就業(yè)維權(quán)的高校教育不到位、就業(yè)維權(quán)意識與行為不對等的問題;二是針對現(xiàn)存的問題,從歷史和現(xiàn)實的角度深入地剖析大學(xué)生就業(yè)維權(quán)意識缺失原因,主要是不良傳統(tǒng)文化的消極影響、就業(yè)法律法規(guī)存在的不足、勞動力市場秩序的不規(guī)范、高校就業(yè)維權(quán)教育的匱乏、就業(yè)維權(quán)自我意識的缺乏五個方面。第四個部分:綜上所述,在發(fā)現(xiàn)大學(xué)生就業(yè)維權(quán)意識存在的問題及原因分析的基礎(chǔ)上,提出大學(xué)生就業(yè)維權(quán)意識的培育內(nèi)容、原則,從環(huán)境、政府、法律、高校、大學(xué)生五個角度,展開論述"五位一體"的大學(xué)生就業(yè)維權(quán)意識培育路徑。
[Abstract]:Under the background of the rule of law in China, the rule of law has become an important prerequisite for building a harmonious society. College students are the backbone of our country's future construction. Safeguarding their employment rights and interests will promote the effective transformation of college students' legal quality and enhance their ability to obtain employment and protect their rights in accordance with the law. It is of great significance to strengthen the practicality of ideological and political education and to build a harmonious labor market with equality and rule of law. How to promote the employment rights by the employment combination method and the law is an important subject facing the ideological and political education in colleges and universities at present. Based on a systematic review of the research on the employment rights of college students at home and abroad, this study applies the literature method. The methods of questionnaire investigation and statistical analysis are guided by Marxist theory and the principles of ideological and political education. This research is divided into the following four parts: the first part is to summarize the relevant research results at home and abroad, to clarify the research ideas and methods, taking the background and significance of the research as the starting point; The second is to introduce the main contents of the employment rights of college students, The second part is to clarify the connotation of "the employment of college students", "the consciousness of safeguarding the rights of employment of college students" and "the cultivation of the consciousness of safeguarding the rights of employment of college students". The second part is to combine the theory of comprehensive development of human beings, the theory of human value, the theory of rights and obligations of Marxism. This paper points out the basis for the cultivation of college students' employment rights awareness, and emphasizes the importance of the cultivation of college students' employment rights protection consciousness, which can promote the effective transformation of college students' legal quality. To enhance the ability of college students to obtain employment and safeguard their rights according to law, to strengthen the practicality of ideological and political education, and to construct an equal and harmonious labor market under the rule of law. The third part: first, in order to further understand the present situation of college students' awareness of employment rights, A questionnaire for college students who are about to graduate or face graduation is made, which includes four dimensions: recognition of employment rights, emotion, behavior and education. It is found that there is a low level of understanding of employment laws and regulations in the awareness of employment rights among college students. The relief channels for employment rights protection are not smooth, the university education for employment rights protection is not in place, and the awareness of employment rights protection is not equal to the behavior; second, it is aimed at the existing problems. From the perspective of history and reality, this paper deeply analyzes the reasons for the lack of awareness of employment rights of college students, mainly the negative influence of bad traditional culture, the deficiency of employment laws and regulations, and the irregularity of labor market order. The lack of employment rights education in colleges and universities, the lack of self-awareness of employment rights. Part four: in summary, on the basis of finding out the problems and causes of employment rights awareness of college students, This paper puts forward the contents and principles of the cultivation of college students' employment rights consciousness, and discusses the cultivation path of the "five-in-one" college students' employment rights consciousness from the five angles of environment, government, law, university and college students.
