【摘要】：大學(xué)生是社會(huì)經(jīng)濟(jì)建設(shè)主要力量,是知識(shí)經(jīng)濟(jì)時(shí)代寶貴的人才資源,是最有希望的高層次、高素質(zhì)、高智商的社會(huì)群體。然而,近些年來,身處象牙塔的大學(xué)生卻多次出現(xiàn)違反道德倫理、觸犯法律法規(guī)的情況,又或者,因缺乏法律意識(shí),越來越多的大學(xué)生成為違法犯罪的對(duì)象和犧牲品。對(duì)此,本文結(jié)合諸多典型案例,利用文獻(xiàn)研究、實(shí)證調(diào)研、訪談的方法,通過多方面、多視角、多層次的方法展現(xiàn)出學(xué)好法律知識(shí),提高高校法律教育質(zhì)量、以及培養(yǎng)“德才兼?zhèn)洹毙腿瞬诺闹匾饬x,并對(duì)當(dāng)代大學(xué)生法律意識(shí)缺失的原因進(jìn)行分析,提出相應(yīng)的培養(yǎng)路徑。本文首先對(duì)法律意識(shí)的相關(guān)概念進(jìn)行了科學(xué)的界定,并對(duì)其特征、結(jié)構(gòu)進(jìn)行了多角度多層次的闡述。其次,通過對(duì)幾所非法律本科院校展開的問卷調(diào)查,分析發(fā)現(xiàn)大學(xué)生中普遍存在對(duì)法律認(rèn)知、法律掌握程度及其運(yùn)用,法律權(quán)利意識(shí)、法律實(shí)踐參與度方面知識(shí)掌握不清、理解不深、運(yùn)用不熟練等多方面的問題,主要是受傳統(tǒng)法治文化和現(xiàn)當(dāng)代法治文化因素、高等教育課程設(shè)置不合理、法律實(shí)踐薄弱、依法治校水平低等教育因素、以及社會(huì)與法律因素、家庭與個(gè)人因素的影響制約。為此,目前我國高等院校學(xué)生法律意識(shí)的培養(yǎng)途徑應(yīng)為:首先要豐富文化、營造完善的法治信仰環(huán)境,優(yōu)化社會(huì)和高校的法律文化。其次應(yīng)當(dāng)設(shè)置科學(xué)的教學(xué)課程、加強(qiáng)法律實(shí)踐教學(xué)、提升依法治校水平、強(qiáng)化教師隊(duì)伍建設(shè)。再次要加強(qiáng)我國社會(huì)中法治教育管理與道德素養(yǎng)建設(shè),凈化當(dāng)前社會(huì)生產(chǎn)、生活環(huán)境,構(gòu)建全民遵法、守法風(fēng)尚。最后,父母應(yīng)該以自身為榜樣,激發(fā)大學(xué)生自我覺醒,養(yǎng)成大學(xué)生遵法守法、崇尚法律的意識(shí)。本文通過上述四種路徑,對(duì)我國當(dāng)前高等院校中學(xué)生進(jìn)行法律意識(shí)培養(yǎng),希望能幫助他們樹立正確的價(jià)值觀、理性地面對(duì)生活,合理地做出選擇,成為對(duì)社會(huì)主義建設(shè)有用的優(yōu)秀人才。
[Abstract]:College students are the main strength of social and economic construction, the valuable talent resources in the era of knowledge economy, and the most promising high level, high quality and high intelligence social group. However, in recent years. College students in the ivory tower appear many times to violate the moral ethics, violate the laws and regulations, or, because of the lack of legal awareness, more and more college students become the object and victim of illegal crimes. This paper combines many typical cases, using literature research, empirical research, interview methods, through various, multi-perspective, multi-level methods to demonstrate the law knowledge, improve the quality of legal education in colleges and universities. And the important significance of cultivating "both moral and talented" talents, and the reasons for the lack of legal consciousness of contemporary college students are analyzed. This paper firstly defines the related concepts of legal consciousness scientifically, and expounds its characteristics and structure from many angles and levels. Secondly. Through the questionnaire survey of several non-law universities, it is found that there is a general awareness of the law, the degree of legal mastery and its application, and the awareness of legal rights among the college students. There are many problems in the aspects of participation in legal practice, such as unclear knowledge, unclear understanding and unskilled application, which are mainly due to the traditional rule of law culture and modern and contemporary rule of law culture factors, and the unreasonable curriculum design of higher education. The legal practice is weak, the educational factors such as the low level of running schools according to law, as well as the influence of social and legal factors, family and individual factors. At present, the ways to cultivate students' legal consciousness in colleges and universities in our country should be as follows: firstly, we should enrich culture, create a perfect environment of belief in the rule of law, and optimize the legal culture of society and colleges, and secondly, we should set up scientific teaching courses. Strengthen the practice of law teaching, improve the level of school management according to law, strengthen the building of teachers. Thirdly, strengthen the rule of law education management and moral literacy in our society, purify the current social production, living environment. Finally, parents should follow their own example, stimulate the self-awareness of college students, develop their awareness of abiding by the law and advocating the law. In order to cultivate the legal consciousness of middle school students in colleges and universities in our country, we hope to help them to set up correct values, face life rationally, make reasonable choices, and become useful talents in socialist construction.
