【摘要】：改革開放近四十年來,我國(guó)經(jīng)濟(jì)發(fā)展迅速,各階層居民生活水平都得到質(zhì)的提高,基本達(dá)到初步的小康水平。但是總體上良好的同時(shí),出現(xiàn)了很多不容問題的問題,尤其是分配正義的問題,政府作為國(guó)家和社會(huì)的管理者,對(duì)解決分配正義問題具有義不容辭的責(zé)任。這一問題的界定與解決,影響著國(guó)家發(fā)展的持續(xù)性和正當(dāng)性。分配正義問題中最突出的是我國(guó)貧富差距巨大,城鄉(xiāng)和地區(qū)發(fā)展不協(xié)調(diào),生存和發(fā)展機(jī)會(huì)不均等。同時(shí),政府的責(zé)任失靈加劇這種不平等。分配正義問題的解決關(guān)乎著全面建成小康社會(huì)的實(shí)現(xiàn),關(guān)乎著民眾對(duì)國(guó)家的信心,更關(guān)乎著人民尊嚴(yán)的維護(hù)。否則,社會(huì)的和諧穩(wěn)定就會(huì)遭受更大的破壞。對(duì)于這一問題的看待與解決,無論是學(xué)術(shù)界,還是黨和政府都提出了很多看法,并產(chǎn)生了一些理論成果�？傮w上包括幾個(gè)方面的內(nèi)容,對(duì)分配正義問題內(nèi)涵的認(rèn)識(shí),現(xiàn)實(shí)問題的分析,及其解決。政府在解決分配正義問題中應(yīng)居于主導(dǎo)地位。本文采用文獻(xiàn)研究法、分析比較法和邏輯與歷史相統(tǒng)一的方法,在了解和掌握已有研究的基礎(chǔ)上分析了我國(guó)分配正義存在的問題,以及政府對(duì)解決這些問題所承擔(dān)的責(zé)任。本文通過對(duì)分配正義和政府責(zé)任內(nèi)涵的界定,提出我國(guó)特色的分配正義的目標(biāo)和原則。在這些原則的指導(dǎo)下,政府在維護(hù)分配正義方面取得了很大的成就,但是在成就的背后,在這一方面還存在著很多問題。對(duì)于政府來講,有外部的市場(chǎng)問題,有政府自身的問題。市場(chǎng)的問題是客觀存在的,政府有責(zé)任和義務(wù)去解決市場(chǎng)不能解決的問題,但是我國(guó)目前存在的分配正義問題與政府權(quán)力有著密切的關(guān)系,政府權(quán)力的越位、錯(cuò)位和缺位,加重了社會(huì)財(cái)富、資源、機(jī)會(huì)分配的不公,這些都違背了政府的責(zé)任性,所以政府更應(yīng)該承擔(dān)解決分配正義問題的責(zé)任。一方面要履行好職責(zé),優(yōu)化社會(huì)資源的分配。另一方面要加強(qiáng)自身的建設(shè),約束和規(guī)范好權(quán)力。
[Abstract]:In the past forty years of reform and opening up, China's economy has developed rapidly, and the living standards of residents of all walks of life have been improved qualitatively, basically reaching a preliminary well-off level. But at the same time, there are many problems, especially the problem of distributive justice. As the manager of the country and society, the government has the duty to solve the problem of distributive justice. The definition and resolution of this problem affects the sustainability and legitimacy of national development. The most prominent problem of distributive justice is the huge gap between rich and poor in our country, the uncoordinated development between urban and rural areas and regional development, and the unequal opportunities for survival and development. At the same time, the failure of government responsibility exacerbates this inequality. The solution of distributive justice is related to the realization of building a well-off society in an all-round way, the confidence of the people in the country, and the maintenance of people's dignity. Otherwise, the harmony and stability of the society will suffer more damage. For the treatment and solution of this problem, both the academia, the Party and the government have put forward a lot of views, and produced some theoretical results. On the whole, it includes several aspects, the understanding of the connotation of distributive justice, the analysis of realistic problems, and its solution. The government should play a leading role in solving the problem of distributive justice. This paper adopts the method of literature research, analyzes the unification of comparative law and logic with history, and analyzes the existing problems of distributive justice in our country on the basis of understanding and mastering the existing research, as well as the responsibility of the government to solve these problems. By defining the connotation of distributive justice and government responsibility, this paper puts forward the objectives and principles of distributive justice with Chinese characteristics. Under the guidance of these principles, the government has made great achievements in the maintenance of distributive justice, but there are still many problems behind the achievements. For the government, there are external market problems, there are problems of the government itself. The problems of the market exist objectively, and the government has the responsibility and obligation to solve the problems that the market cannot solve, but the problem of distribution justice existing in our country is closely related to the power of the government, the offside, the dislocation and the absence of the power of the government. It aggravates the unfair distribution of social wealth, resources and opportunities, all of which violate the responsibility of the government, so the government should bear the responsibility to solve the problem of distributive justice. On the one hand, we should fulfill our responsibilities and optimize the allocation of social resources. On the other hand, we should strengthen our own construction, restrain and standardize power.
