【摘要】：我國目前正處于和諧社會(huì)構(gòu)建的大環(huán)境中,各項(xiàng)政治制度應(yīng)該要為這一目標(biāo)任務(wù)的實(shí)現(xiàn)發(fā)揮重要作用。我國的信訪制度是具有社會(huì)主義特色的政治制度之一,它不僅有著源遠(yuǎn)流長的歷史,更擁有堅(jiān)實(shí)的社會(huì)基礎(chǔ)。在現(xiàn)實(shí)生活當(dāng)中,信訪制度不斷承擔(dān)著多項(xiàng)功能:政府監(jiān)督、權(quán)利保障、糾紛化解、矛盾解決、利益訴求等。可是從信訪制度創(chuàng)立之日開始,伴隨著社會(huì)環(huán)境的不斷變化,它在不同階段表現(xiàn)出不同的政治功能,信訪制度的政治功能發(fā)生了變遷,這對于政權(quán)的穩(wěn)定和社會(huì)的發(fā)展產(chǎn)生了很大的影響。面對著如今的經(jīng)濟(jì)、政治和社會(huì)環(huán)境的變化,信訪制度遭受著各種問題的困擾:信訪總數(shù)不斷增加、越級上訪層出不窮、涉法涉訴信訪量顯著增加、非正常的上訪活動(dòng)如雨后春筍不斷涌現(xiàn),信訪活動(dòng)的組織性和對抗性明顯增強(qiáng)等�；谝陨系膯栴}的產(chǎn)生有千般的原因,但筆者認(rèn)為要認(rèn)真分析信訪制度陷入困境的原因,就要結(jié)合現(xiàn)階段的社會(huì)結(jié)構(gòu)變化。面對著信訪制度在新時(shí)期表現(xiàn)出的各種不適應(yīng),國內(nèi)的一些學(xué)者對于信訪制度提出不同的聲音,信訪制度是去是留?再者,實(shí)際生活中,信訪制度確實(shí)不斷出現(xiàn)各種問題和矛盾。那么信訪制度到底應(yīng)該何去何從?本文從信訪制度根植于中國、發(fā)展于中國論述,通過對信訪制度發(fā)展的詳細(xì)研究,了解信訪發(fā)展整個(gè)過程,在信訪制度發(fā)展的不同階段,信訪制度分別負(fù)擔(dān)著不同的政治功能。經(jīng)過時(shí)間的推移,信訪制度政治功能不斷地發(fā)生著變遷,其原因正是因?yàn)檎�、�?jīng)濟(jì)和社會(huì)環(huán)境的變化。那么面對著新情況,信訪制度又表現(xiàn)出怎樣的不適應(yīng),究竟是什么原因促使信訪制度陷入了困境?分析目前我國的信訪制度面臨的一些問題,在社會(huì)主義的民主化道路上繼續(xù)前行,信訪制度應(yīng)該做出相對應(yīng)調(diào)整,更好地讓信訪制度為社會(huì)主義中國服務(wù),更好地為中國民眾服務(wù)。
[Abstract]:At present, our country is in the environment of constructing a harmonious society, and every political system should play an important role in the realization of this goal task. The system of letters and visits is one of the political systems with socialist characteristics. It not only has a long history, but also has a solid social foundation. In real life, the system of letters and visits has many functions: government supervision, right protection, dispute resolution, conflict resolution, interest demand and so on. However, since the establishment of the petition system, with the continuous changes of the social environment, it has shown different political functions at different stages, and the political function of the petition system has changed. This has had a great impact on the stability of the regime and the development of society. In the face of the changes in the economic, political and social environment today, the petition system is beset by various problems: the total number of letters and visits has been increasing, the number of petition cases has been increasing, and the number of petitions and visits involving legal claims has increased significantly. Abnormal petition activities, such as springing up constantly, the organization and antagonism of petition activities increased significantly. Based on the above problems, there are many reasons, but the author thinks that if we want to seriously analyze the reason why the petition system is in trouble, we must combine the changes of social structure at the present stage. Facing all kinds of maladjustment of the petition system in the new period, some domestic scholars put forward different voices for the petition system. Is the letter and visit system to stay or not? Moreover, in the actual life, the letter-to-visit system does appear each kind of question and the contradiction unceasingly. So where should the petition system go? This article from the letter to visit system rooted in China, develops in the Chinese elaboration, through the detailed research to the letters and visits system development, understands the letter and visits development entire process, in the letter and visits system development different stages, the letter and visits system respectively bears the different political function. With the passage of time, the political function of petition system is constantly changing, which is due to the changes of political, economic and social environment. So in the face of the new situation, how does the petition system not adapt, and what causes the petition system to get into a dilemma? By analyzing some problems faced by the petition system in our country at present, we should continue to move forward on the road of socialist democratization, and the petition system should be adjusted accordingly so as to better let the petition system serve socialist China. Better serve the Chinese people.
