【摘要】：政府職能一直是學(xué)術(shù)界和實(shí)踐界廣泛關(guān)注的問題。在市場(chǎng)化日益繁榮、法制建設(shè)日益完善的現(xiàn)代社會(huì),全球范圍內(nèi)主要國(guó)家的政府基本上都通過行政改革來實(shí)現(xiàn)政府職能的調(diào)整,以進(jìn)一步適應(yīng)市場(chǎng)經(jīng)濟(jì)和社會(huì)發(fā)展的需要。我國(guó)建設(shè)服務(wù)型的政府,其中一個(gè)主要方式就是行政審批制度改革,以實(shí)現(xiàn)政府、市場(chǎng)、社會(huì)的重新定位,更好地促進(jìn)經(jīng)濟(jì)和社會(huì)的發(fā)展。我國(guó)的行政審批制度改革歷時(shí)15年,目前在數(shù)量上已經(jīng)取得較為矚目的成績(jī),在審批事項(xiàng)、審批方式和審批流程上進(jìn)行了較為有力的改革,但市場(chǎng)和社會(huì)對(duì)審批改革成果的感知程度還是不容樂觀,還存在著機(jī)制、制度、觀念等方面的一系列問題。本文通過大量的文獻(xiàn)研究,在對(duì)我國(guó)行政審批制度改革現(xiàn)狀進(jìn)行梳理和分析的基礎(chǔ)上,以服務(wù)型政府理論和“國(guó)家—社會(huì)”理論為指導(dǎo),分析了我國(guó)行政審批改革中存在的服務(wù)觀念欠缺、審改工作形式主義嚴(yán)重、審批工作監(jiān)督乏力和配套機(jī)構(gòu)功能不足等問題,并從歷史、制度、機(jī)制等多個(gè)層面進(jìn)行了原因剖析。在此基礎(chǔ)上,從樹立正確的行政審批改革的價(jià)值取向、強(qiáng)化行政審批配套制度、打造現(xiàn)代化的行政審批流程和完善配套機(jī)構(gòu)建設(shè)四個(gè)方面提出構(gòu)建更加規(guī)范化、法制化的行政審批制度的對(duì)策建議,以期為行政審批制度的進(jìn)一步改革提供參考。
[Abstract]:The function of government has always been concerned by academic circles and practice circles. In the modern society where the marketization is flourishing and the legal system is being constructed increasingly, the governments of the major countries in the world have basically realized the adjustment of government functions through administrative reform in order to further meet the needs of market economy and social development. One of the main ways to construct a service-oriented government in China is to reform the administrative examination and approval system in order to reorient the government, market and society to promote the development of economy and society. The reform of the administrative examination and approval system in our country lasted for 15 years. At present, it has achieved remarkable results in terms of quantity. It has carried out more effective reforms in terms of examination and approval items, examination and approval methods and examination and approval process. However, the market and society's perception of the results of examination and approval reform is not optimistic, and there are still a series of problems in the aspects of mechanism, system, concept and so on. Based on the analysis of the current situation of the reform of administrative examination and approval system in China, this paper is guided by the theory of service-oriented government and the theory of "state-society". This paper analyzes the problems in the reform of administrative examination and approval in our country, such as lack of service concept, serious formalism, weak supervision of examination and approval work and insufficient function of supporting institutions, and analyzes the reasons from history, system, mechanism and other aspects. On this basis, from four aspects of setting up the correct value orientation of the reform of administrative examination and approval, strengthening the supporting system of administrative examination and approval, building up the modernized administrative approval process and perfecting the construction of supporting institutions, the author puts forward four aspects to construct more standardized. The countermeasures and suggestions of the legalized administrative examination and approval system are expected to provide reference for the further reform of the administrative examination and approval system.
