我國第三部門公共治理權(quán)研究

【摘要】:自改革開放以來,我國的社會制度和社會結(jié)構(gòu)在經(jīng)濟(jì)發(fā)展的澎湃浪潮中發(fā)生著劇烈的變革。在這個(gè)過程中,不僅政府與企業(yè)的關(guān)系發(fā)生了前所未有的變化,還出現(xiàn)了與政府、市場主體相并立的第三部門這一社會主體,并且隨著政府職能的轉(zhuǎn)變,第三部門在社會管理中行使著越來越多的公共治理權(quán)。根據(jù)現(xiàn)有的學(xué)術(shù)研究和實(shí)務(wù)規(guī)則來看,在“國家-社會-市場”的結(jié)構(gòu)背景下,我們對初現(xiàn)端倪的公共治理(公共行政)和公共權(quán)力的關(guān)注顯然不夠,公共治理權(quán)的相關(guān)法律問題亟待思考與探討。在借鑒社會學(xué)、政治學(xué)、經(jīng)濟(jì)學(xué)、組織學(xué)、公共管理學(xué)乃至哲學(xué)、法理學(xué)等學(xué)科知識和研究的基礎(chǔ)上,筆者試圖從我國公法特別是行政法的角度對此作出初步嘗試。本文共包括四個(gè)部分,分別是緒論(含有關(guān)第三部門的基本問題)、對我國第三部門公共治理權(quán)的本體考察、我國第三部門公共治理權(quán)的現(xiàn)狀及相關(guān)建議、結(jié)語。其中,緒論部分獨(dú)立成章,筆者對選題背景、國內(nèi)外研究現(xiàn)狀、本論文題的探索意義、嘗試的研究方法和有關(guān)第三部門的基本問題做了相應(yīng)介紹;第二部分是全文的核心問題所在,筆者將其分成三個(gè)板塊,并從五個(gè)方面對我國第三部門的公共治理權(quán)予以本體考察,具體包括其涵義及權(quán)力來源、法律性質(zhì)與特征以及該權(quán)力的正當(dāng)性分析;第三部分是從社會實(shí)踐的外部視角對該權(quán)力的運(yùn)行現(xiàn)狀及相關(guān)原因進(jìn)行了理論探討,并就制度設(shè)計(jì)方面,筆者提出了一些淺見作為建議;在最后的結(jié)語部分,筆者對該問題進(jìn)行了相應(yīng)的總結(jié)歸納。綜合分析后可知,我國第三部門的公共治理權(quán)是我國第三部門在社會活動中,對公共事務(wù)進(jìn)行管理的權(quán)力,包括國家準(zhǔn)行政權(quán)力和社會公行政權(quán)力。不是所有的第三部門都同時(shí)具有該權(quán)力的全部內(nèi)容,在第三部門進(jìn)行不同活動的過程中,其法律性質(zhì)因所行使權(quán)力的具體來源而不同。我國第三部門公共治理權(quán)的權(quán)力來源主要有兩種:國家授權(quán)或委托,以及成員間契約。與之相應(yīng),有前者來源的公共治理權(quán)具有行政權(quán)的性質(zhì),有后者來源的則是與社會公行政相關(guān)的公共權(quán)力,具有效力上的有限性和功能上的雙重性的特征。其正當(dāng)性具體表現(xiàn)在:行政分權(quán)與行政權(quán)的一般發(fā)展規(guī)律相符,行政分權(quán)符合我國行政權(quán)的發(fā)展趨勢;社會公行政有利于民主化的推進(jìn),社會公行政有利于公共治理效率的提高;谖覈厥獾纳鐣尘,政府在處理與第三部門的關(guān)系時(shí)擰巴別扭不順暢,造成公共治理權(quán)存在權(quán)力內(nèi)容欠明確、運(yùn)行不規(guī)范、該有的正常監(jiān)督缺位等情況。對此,如何理順政府與第三部門的關(guān)系成為制度設(shè)計(jì)上需考慮的首要問題。具體而言,從法律規(guī)則層面上說,要明確第三部門公共治理權(quán)的內(nèi)容;從實(shí)踐運(yùn)行層面上說,要加快轉(zhuǎn)變政府職能,從多方面對第三部門公共治理權(quán)的運(yùn)行與監(jiān)督進(jìn)行規(guī)范。
[Abstract]:Since the reform and opening up, China's social system and social structure have undergone drastic changes in the surging tide of economic development. In this process, not only the relationship between government and enterprises has undergone unprecedented changes, but also the third sector, which stands side by side with the government and the main body of the market, has emerged, and with the transformation of government functions, The third sector is exercising more and more public governance power in social management. In the light of existing academic research and practical rules, in the context of the "State-social-market" structure, it is clear that our focus on emerging public governance (public administration) and public power is inadequate. The related legal problems of public administration right need to be considered and discussed urgently. On the basis of learning from the knowledge and research of sociology, politics, economics, organization, public management and even philosophy and jurisprudence, the author tries to make a preliminary attempt from the angle of public law, especially administrative law. This paper consists of four parts, which are the introduction (including the basic problems of the third sector), the Noumenon investigation of the third sector's public governance right, the present situation and relevant suggestions of the third sector's public governance right, and the conclusion. Among them, the introduction part of the independent chapters, the author selected the background, domestic and foreign research status, the significance of the topic of this paper, try to research methods and related to the third sector of the basic issues made a corresponding introduction; The second part is the core problem of the full text, the author divides it into three sections, and from five aspects of the third sector of public governance rights to be ontologically investigated, including its meaning and power sources, The third part discusses the current situation and related reasons of the power from the external perspective of social practice, and discusses the system design of the power, the third part is the analysis of the legal nature and characteristics as well as the legitimacy of the power. After comprehensive analysis, we can know that the power of public administration in the third sector of our country is the power to manage public affairs in the social activities of the third sector of our country, including the quasi-administrative power of the state and the public administrative power of the society. In the process of carrying out different activities in the third sector, the legal nature of the third sector varies according to the specific source of the power exercised. There are two kinds of power sources of public governance power in the third sector of our country: state authorization or entrustment, and contract between members. Accordingly, the public governance power from the former source has the nature of administrative power, while the latter comes from the public power related to the social public administration, which has the characteristics of limited validity and dual function. Its legitimacy is embodied in the following aspects: administrative decentralization accords with the general law of development of administrative power, administrative decentralization accords with the development trend of administrative power in our country, and social public administration is conducive to the promotion of democratization. Public administration is conducive to improving the efficiency of public governance. Based on the special social background of our country, the relationship between the government and the third sector is not smooth, resulting in the lack of clear power content, irregular operation and the absence of normal supervision. Therefore, how to straighten out the relationship between the government and the third sector has become the most important issue in the system design. Specifically, from the level of legal rules, it is necessary to make clear the content of the third sector's public governance right, to speed up the transformation of government functions, and to standardize the operation and supervision of the third sector's public governance right from various aspects.
