【摘要】：治理違法建筑之路崎嶇而漫長,違建問題困擾每個(gè)城市的治理階層,深圳也不例外。改革開放以來,隨著深圳城市化進(jìn)程不斷深入,因違法建筑引起的紛爭甚至沖突日漸凸顯,違法建筑侵害了大多數(shù)群眾的合法權(quán)益和社會公共利益,給政府城市管理帶來了難題,已經(jīng)成為嚴(yán)重制約深圳城市發(fā)展的瓶頸。探討治理違法建筑工作的有效思路,妥善解決違法建筑問題,對緩解社會矛盾、維護(hù)群眾合法權(quán)益和社會公共利益、構(gòu)建和諧社會,無疑是具有重大深遠(yuǎn)意義的。本文一共包含五個(gè)主要部分。在第一部分,筆者首先闡明研究的背景和意義,接著對國外關(guān)于違法建筑的整治策略進(jìn)行介紹,對國內(nèi)研究現(xiàn)狀進(jìn)行分析。在文章的第二部分,著重介紹了公共治理理論及程序正義理論,同時(shí),在此基礎(chǔ)上結(jié)合我國法律法規(guī),對違法建筑進(jìn)行界定,根據(jù)違法建筑的不同特點(diǎn)進(jìn)行分類,并總結(jié)了違法建筑的危害性。在接下來的部分,筆者重點(diǎn)剖析了坪山新區(qū)治理違法建筑工作的現(xiàn)狀以及遇到的問題。第四部分,針對坪山新區(qū)治理違法建筑的困境,筆者提出了完善法律法規(guī)體系,拓寬群眾參與治理途徑,規(guī)范執(zhí)法程序,完善配套保障措施,加大宣傳力度五方面的建議對策。文章最后一部分,為結(jié)語與展望。
[Abstract]:The road to deal with illegal construction is rugged and long. The problem of illegal construction puzzles the administrative class of every city. Shenzhen is no exception. Since the reform and opening up, with the deepening of the process of urbanization in Shenzhen, disputes and even conflicts caused by illegal buildings have become increasingly prominent, and illegal buildings have infringed on the legitimate rights and interests of the majority of the people and the public interests of the society. It has brought difficulties to government urban management and has become a bottleneck restricting the development of Shenzhen city. It is undoubtedly of great significance to probe into the effective ideas of managing illegal construction and properly solve the problem of illegal building, which is of great significance to alleviate social contradictions, safeguard the legitimate rights and interests of the masses and social public interests, and build a harmonious society. There are five main parts in this paper. In the first part, the author first clarifies the background and significance of the research, then introduces the foreign remediation strategies about illegal buildings, and analyzes the present situation of domestic research. In the second part of the article, the author mainly introduces the theory of public governance and the theory of procedural justice. At the same time, combining with the laws and regulations of our country, the author defines the illegal building and classifies it according to the different characteristics of the illegal building. And summarized the harmfulness of illegal building. In the following part, the author analyzes the current situation and problems of the management of illegal construction in Pingshan New District. In the fourth part, in view of the predicament of administering illegal buildings in Pingshan New District, the author puts forward five suggestions on perfecting the system of laws and regulations, widening the ways for the masses to participate in the governance, standardizing the law enforcement procedures, perfecting the supporting safeguard measures, and increasing the propaganda intensity. The last part of the article is the conclusion and prospect.
