【摘要】：國家監(jiān)察體制改革方案的公布,落實(shí)了習(xí)近平總書記提出的"完善監(jiān)督制度,做好監(jiān)督體系頂層設(shè)計(jì),健全國家監(jiān)察組織機(jī)構(gòu),形成全面覆蓋國家機(jī)關(guān)及其公務(wù)員的國家監(jiān)察體系"要求。設(shè)立監(jiān)察委員會(huì),賦予其憲制上的國家監(jiān)察權(quán)應(yīng)符合堅(jiān)持改革、精簡高效、人民主權(quán)和法治等憲法精神和原則。本文通過分析監(jiān)察委員會(huì)的性質(zhì)及地位、組成架構(gòu)和主要職權(quán)從而論證監(jiān)察委員會(huì)的憲法定位。
[Abstract]:The announcement of the plan for the reform of the state supervision system has implemented General Secretary Xi Jinping's proposal of "perfecting the supervision system, doing a good job of designing the top level of the supervision system, and perfecting the state supervisory organization," Form a comprehensive coverage of state organs and civil servants of the state supervision system "requirements." The establishment of a supervisory committee and the granting of its constitutional supervisory power should conform to the spirit and principles of the Constitution, such as upholding reform, streamlining and efficiency, people's sovereignty and the rule of law. By analyzing the nature and status of the supervisory committee, the constitution of the supervisory committee and its main functions and powers are discussed in this paper.
