公益財產(chǎn)法律監(jiān)管制度研究

【摘要】:自我國公益組織經(jīng)過近二十多年的發(fā)展,公益性的款物不斷地得以募集,公益活動的領(lǐng)域不斷地得以拓展,由此公益逐漸地步入公眾的視野,受到社會公眾的高度關(guān)注。但是,由于我國實(shí)行市場經(jīng)濟(jì),市場在資源配置中起決定作用,這使得公益事業(yè)在發(fā)展實(shí)踐中存在著許多問題,尤其是公益財產(chǎn)的作為公益組織生存和發(fā)展的基礎(chǔ),它在市場經(jīng)濟(jì)中存在的問題更是不容忽視。從早期的“胡曼莉”、“付廣榮”,到“天價帳篷”和“萬元餐費(fèi)”事件,加之郭美美、河南宋基會事件,透露出我國公益財產(chǎn)存在著大量不合理、不合法使用的現(xiàn)象,折射著我國公益事業(yè)無論是在國家的法律監(jiān)管還是公眾的社會監(jiān)管,再或者自身在發(fā)揮社會功能上,都十分有限。如果就目前我國公益事業(yè)的現(xiàn)狀而言,公益財產(chǎn)的局限性在互聯(lián)網(wǎng)媒體的“推波助瀾”下,似乎已經(jīng)把公益組織推到了風(fēng)口浪尖上,其破壞性史無前例,公益事業(yè)公信力受到毀滅性的打擊,嚴(yán)重制約著公益事業(yè)的有效運(yùn)行。因此,有效地解決公益財產(chǎn)存在的各種問題,就迫切需要在法律上對公益財產(chǎn)的監(jiān)管進(jìn)行規(guī)范,同時也為公眾、媒體等社會力量的監(jiān)管提供法律依據(jù)。本文的研究脈絡(luò),首先是提出問題,引出本文研究的主題,進(jìn)而是分析問題,探究出現(xiàn)問題的原因,最后解決問題,得出規(guī)避這些問題的對策。即運(yùn)用案例作為本文的開篇,有力地提出當(dāng)前我國公益財產(chǎn)存在的一系列令人深思的問題,其次通過對公益財產(chǎn)相關(guān)問題的論述,比如公益財產(chǎn)的性質(zhì)、公益財產(chǎn)監(jiān)管的必要性等為后文提出公益財產(chǎn)的監(jiān)管措施做鋪墊,然后借鑒不同國家對公益財產(chǎn)的監(jiān)管經(jīng)驗,明確對我國公益財產(chǎn)進(jìn)行有效法律監(jiān)管的層次,即要形成統(tǒng)一的法律監(jiān)管體制,包括立法監(jiān)管和行政監(jiān)管,最后通過對信息披露制度的厘清與闡述,信息披露制度對保障監(jiān)管落實(shí)的重要意義。第一章:導(dǎo)論。本章主要論述了選擇公益財產(chǎn)作為本課題理由以及理論、實(shí)踐意義,并在加工整理搜集文獻(xiàn)的基礎(chǔ)上形成本文的研究綜述,闡明了國內(nèi)外理論界對本選題的研究現(xiàn)狀。第二章:公益財產(chǎn)監(jiān)管的理論分析。論述了公益財產(chǎn)監(jiān)管的必要性和重要性,并且針對我國公益財產(chǎn)現(xiàn)存問題提出公益財產(chǎn)監(jiān)管的原則。第三章:我國公益財產(chǎn)監(jiān)管制度及存在的問題。本章提出我國公益財產(chǎn)監(jiān)管制度的是雙重管理體制,這種監(jiān)管體制有諸多不足,使公益財產(chǎn)也不斷受到損失,帶來的是公眾的不信任,同時本章還指出我國對監(jiān)管體制的法律法規(guī)仍需完善。第四章:完善公益財產(chǎn)相關(guān)立法。本章提出在完善公益財產(chǎn)立法方面的所要采取的措施,比如制定公益財產(chǎn)法律規(guī)范,尤其是制定專門的公益財產(chǎn)法,以此來規(guī)范公益財產(chǎn)的使用行為。加之,作為本文的最后一章,信息披露制度是公益財產(chǎn)的重要防線,必須健全信息披露制度,明確信息披露制度的法律責(zé)任,切實(shí)保障公益財產(chǎn)的有效使用?傊,只有加大對公益組織的監(jiān)管力度,加強(qiáng)公益事業(yè)的法制建設(shè),對公益領(lǐng)域中的違法犯罪給予嚴(yán)厲懲治,才能真正保證公益事業(yè)運(yùn)行不偏離軌道。
[Abstract]:After nearly more than 20 years of development, the public welfare organizations have been continuously raised, and the fields of public welfare have been continuously expanded. Therefore, public welfare gradually enters the public field of vision and is highly concerned by the public. However, because of the implementation of the market economy, the market plays a decisive role in the allocation of resources, which makes it possible that the market economy will play a decisive role in the allocation of resources. There are many problems in the development of public welfare, especially the basis for the survival and development of public welfare property, which can not be ignored in the market economy. From the early "Hu Manli", "Fu Guangrong", "Heaven price tent" and "ten thousand yuan meal", and Jocie Guo, Henan song Ji society The phenomenon reveals that there are a lot of irrational and unlawful use of public welfare property in our country, which reflects that the public welfare undertakings of our country are very limited, whether they are in the state's legal supervision or public supervision, or in their own social functions. If the present situation of public welfare undertakings in our country is concerned, the limitations of public welfare property are limited. Under the "push the waves of the Internet media", sex seems to have pushed the public welfare organization to the top of the wind and waves. Its destructive history is unprecedented. The public credibility of public welfare is devastating, which seriously restricts the effective operation of public welfare undertakings. Therefore, the effective solution to the various problems of public welfare property is urgently needed in law. The supervision of public welfare property is standardized, and it also provides legal basis for the supervision of the public and the media and other social forces. The research context of this article is first to put forward the questions, to lead to the subject of this study, to analyze the problems, to explore the reasons for the problems, to solve the questions at the end and to get the countermeasures to avoid these problems. That is, the use of cases as a case. In the beginning of this article, a series of thought-provoking problems exist in the current public property of our country. Secondly, through the discussion of the problems related to public welfare property, such as the nature of public welfare property, the necessity of the supervision of public welfare property, and so on, it lays the paving for the supervision measures of public welfare property, and then draws lessons from different countries for public welfare property. Supervision experience, clear the level of effective legal supervision of public welfare property in China, that is to form a unified legal supervision system, including legislative supervision and administrative supervision, and finally through the clarification and exposition of the information disclosure system, the information disclosure system is of great importance to the implementation of the guarantee supervision. The public property as the reason and theory, practical significance, and on the basis of the collection of documents in the processing and collation to form the research summary of this article, clarifies the research status of the theoretical circles at home and abroad on this topic. The second chapter: the theoretical analysis of the supervision of public welfare property. The necessity and importance of the supervision of public welfare property are discussed, and it is also aimed at our country. The existing problems of public welfare property put forward the principle of public welfare property supervision. The third chapter: the supervision system of public welfare property in our country and the existing problems. This chapter puts forward that the supervision system of public welfare property in our country is a dual management system. This supervision system has many shortcomings, so that the public property is constantly lost, and the public's distrust is brought. At the same time this chapter is the chapter. It also points out that China's laws and regulations on the regulatory system still need to be perfected. The fourth chapter is to improve the relevant legislation of public welfare property. This chapter puts forward measures to be taken to improve public welfare property legislation, such as the formulation of the legal norms of public welfare property, especially the formulation of special public welfare property law, in order to standardize the use of public welfare property. For the last chapter of this article, the information disclosure system is an important line of defense for public welfare property. It is necessary to improve the information disclosure system, clarify the legal responsibility of the information disclosure system, and effectively ensure the effective use of public welfare property. In a word, it is necessary to strengthen the supervision of public welfare organizations, strengthen the legal construction of public welfare undertakings and the illegal offenders in the public welfare field. Only by punishing severely, can we truly ensure that the operation of public welfare does not deviate from the orbit.
