吉林省機構編制信息公開的界限研究

【摘要】:隨著人類社會進入信息飛速增長的時代浪潮,信息在國家管理和人們生活中扮演著不可或缺的角色,政府作為信息資源最大的擁有者,其對政府信息的開放程度代表著對公民知情權的保護力度。為制約政府逃避履行信息公開義務,世界各國相繼頒布了政府信息公開制度,并普遍采用“公開為原則,不公開為例外”的立法理念,但公開例外的不同決定了信息公開界限的差異。我國政府信息公開起步較晚,2007年頒布的《政府信息公開條例》規(guī)定行政機關有義務向社會公眾公開政府信息,確定了應當主動公開和依申請公開的信息范圍,而對公開例外僅作了原則性規(guī)定,即不得公開涉及國家秘密、商業(yè)秘密和個人隱私的政府信息。事實上,這樣的例外規(guī)則過于籠統(tǒng)寬泛,行政機關常以涉密為由拒絕公開,嚴重妨害了公民對政府信息公開的滿意度。本文以政府信息公開的界限研究為主題,旨在探討如何實現(xiàn)政府信息公開范圍的最大化,從最關鍵的環(huán)節(jié)入手促進政府信息公開水平的提升。以吉林省機構編制信息為例進行研究,提出機構編制信息公開界限的確定方法,力圖從微觀見宏觀,為各行政領域合理確定政府信息公開界限提供有益幫助。本文首先以控權平衡理論為基礎,闡述了政府信息公開界限問題的發(fā)展歷程和理論分析,詳細描述了吉林省機構編制信息公開的現(xiàn)狀,并總結了問題、分析了原因。通過對國內(nèi)外機構編制信息公開界限情況的比較和借鑒,提出了吉林省機構編制信息公開界限確定方法的有關建議,為吉林省機構編制部門推進政務公開,優(yōu)化服務職能,打造“陽光編制”建言獻策。
[Abstract]:With the rapid development of information in human society, information plays an indispensable role in national management and people's life. The government is the largest owner of information resources. The degree of openness to government information represents the protection of citizens' right to know. In order to restrict the government from fulfilling its obligation to disclose information, various countries in the world have promulgated the system of government information disclosure one after another, and generally adopted the principle of "openness as the principle". The idea of not making the public an exception, However, the differences in the limits of information disclosure are determined by the differences in the exceptions to disclosure. The opening of government information in our country started relatively late. The regulations on the publicity of Government Information promulgated in 2007 stipulate that administrative organs have the obligation to disclose government information to the public. Determining the scope of information that should be made public on its own initiative and on request, while the exception to disclosure is only provided in principle, that is, government information relating to state secrets, trade secrets and personal privacy shall not be made public... in fact, Such an exception rule is too general and broad, and the administrative authorities often refuse to disclose it on the grounds of confidentiality, which seriously hinders citizens' satisfaction with the disclosure of government information. This paper focuses on the study of the limits of government information disclosure. The purpose of this paper is to explore how to maximize the scope of government information disclosure and to promote the improvement of the level of government information disclosure from the most critical links. This paper puts forward a method to determine the limits of information disclosure in the establishment of institutions, and tries to provide useful help for the rational determination of the limits of government information disclosure in various administrative fields from the macro perspective. Firstly, this paper is based on the theory of balance of control power. This paper expounds the development course and theoretical analysis of the limits of government information disclosure, describes in detail the present situation of the establishment of information disclosure in Jilin Province, and summarizes the problems. This paper analyzes the reasons. Through the comparison and reference of the limits of the information disclosure of the domestic and foreign organizations, the paper puts forward some suggestions on how to determine the limits of the information disclosure of the institutions in Jilin Province, in order to promote the openness of government affairs for the departments of the establishment of the institutions in Jilin Province. Optimize the service function, create "sunshine system" advice.
