【摘要】：隨著中國社會(huì)步入轉(zhuǎn)型期,公共服務(wù)領(lǐng)域也逐步開始向市場化轉(zhuǎn)型。但在轉(zhuǎn)型過程中,市場化引發(fā)了諸多問題。根據(jù)交易成本理論分析,造成這些外部性問題的原因在于購買服務(wù)中沉沒成本的"二難命題"。在該二難命題中,一方面,受托方受資產(chǎn)專用性、檸檬市場之困擾,產(chǎn)生沉沒成本;另一方面,政府為避免上述問題,采用了長期契約、市場介入等手段,卻又遭遇契約不完全性、路徑依賴之困擾,被迫承擔(dān)轉(zhuǎn)嫁之沉沒成本。因此,政府干預(yù)公共服務(wù)市場后,沉沒成本的問題其實(shí)并未被消除,而是從受托人轉(zhuǎn)嫁給了委托人。通過分析問題之根源,發(fā)現(xiàn)政府行動(dòng)策略選擇之失誤,即以行政手段代替市場的治理手段是淺層病灶。而造成這一淺層病灶之深層根源則在于政府抽離委托代理關(guān)系之雙層架構(gòu),令其從"公眾—政府—受托組織"之復(fù)合式結(jié)構(gòu)簡化為"政府—受托組織"之單層結(jié)構(gòu)。受此影響,社會(huì)力量無法參與到市場治理之中,而政府所依賴之行政力量又不契合公共服務(wù)之市場化結(jié)構(gòu),從而導(dǎo)致沉沒成本之"二難命題"。為了解決這一問題,政府應(yīng)從社會(huì)、市場、法制三個(gè)方面同時(shí)推動(dòng)改革,從而形成一個(gè)全新的公共服務(wù)市場治理"三位一體"整體架構(gòu)。
[Abstract]:With the transition of Chinese society, the field of public service has gradually begun to transform to marketization. However, in the process of transformation, marketization has caused many problems. The reason for these externalities lies in the "difficult proposition" of sunk cost in the purchase of services. In this proposition, on the one hand, the client is troubled by asset specificity and the lemon market, resulting in sunk costs; on the other hand, In order to avoid the above problems, the government has adopted long-term contract, market intervention and other means, but also encountered contract incompleteness, path dependence, forced to bear the sunk cost of transfer. Therefore, after government intervention in the public service market, The problem of sunk cost has not actually been eliminated, but has been passed on from the trustee to the principal. By analyzing the root of the problem, we find that the government has made a mistake in choosing its strategy for action. That is, the administrative means instead of the market are shallow lesions, and the underlying cause of this shallow lesion lies in the government pulling away the two-tier structure of the principal-agent relationship. That simplifies it from a "public-government-fiduciary" composite structure to a "government-fiduciary" monolayer structure. As a result, social forces are unable to participate in market governance. In order to solve this problem, the government should promote the reform from three aspects: the society, the market and the legal system. Thus forming a brand-new public service market governance "trinity" overall framework.
