制約與監(jiān)督:高校行政權(quán)力的控制機(jī)制研究

【摘要】:高校是由國(guó)家法律授權(quán)的特殊行政權(quán)力主體,近年來(lái)已成為行政管理學(xué)重要研究對(duì)象。首先,高校隸屬于政府,政府又對(duì)高校實(shí)行行政管理,這使得高校相對(duì)于其他行政機(jī)關(guān)而言更具封閉性,容易造成監(jiān)督乏力;其次,高校以行政、學(xué)術(shù)二元權(quán)力結(jié)構(gòu)為主,且行政權(quán)力主體又具有“管控”與“服務(wù)”的雙重身份,形成了集中型管理體制,容易導(dǎo)致失衡。實(shí)踐表明,高校已成為腐敗犯罪新的高發(fā)區(qū)。這無(wú)疑與高校行政權(quán)力控制機(jī)制存在的缺陷有著一定關(guān)聯(lián),而目前該領(lǐng)域的理論研究較少。因此,在全面推進(jìn)國(guó)家治理體系和治理能力現(xiàn)代化的背景下,研究高校行政權(quán)力的控制機(jī)制,已成為亟需解決且極富現(xiàn)實(shí)意義的重要課題。基于對(duì)國(guó)內(nèi)外相關(guān)文獻(xiàn)的梳理,提出了行政權(quán)力的兩種控制方式:權(quán)力制約與權(quán)力監(jiān)督。并從權(quán)力主客體關(guān)系、權(quán)力配置方式、權(quán)力運(yùn)行機(jī)制和責(zé)任追究形式四個(gè)方面比較了兩者的差異:權(quán)力制約研究權(quán)力系統(tǒng)內(nèi)部的力量,是以分權(quán)為前提的一種雙向約束和牽制關(guān)系,由于所有權(quán)力主體都參與到整個(gè)權(quán)力運(yùn)行過(guò)程,在責(zé)任追究上其需共同承擔(dān)直接責(zé)任;而權(quán)力監(jiān)督研究權(quán)力主體的外部力量對(duì)權(quán)力主體的監(jiān)控和督促,是以授權(quán)為前提的單向關(guān)系,由于其只覆蓋權(quán)力運(yùn)行過(guò)程中的某個(gè)環(huán)節(jié),在責(zé)任追究上只需承擔(dān)間接責(zé)任。高校行政權(quán)力控制是一種特殊形式的權(quán)力控制,具有不同于其他行政權(quán)力控制的特點(diǎn),經(jīng)過(guò)初步考察,文章提出高校行政權(quán)力制約與權(quán)力監(jiān)督具有建設(shè)趨于制度化、監(jiān)督主體多元化、制約運(yùn)行非制衡性等特點(diǎn)。根據(jù)對(duì)不同建制主體制定的高校行政控權(quán)制度的分析,指出當(dāng)前高校行政的行政權(quán)力制約機(jī)制和行政權(quán)力監(jiān)督機(jī)制。在此基礎(chǔ)上,進(jìn)一步地剖析了其特點(diǎn)與缺陷。根據(jù)對(duì)若干高校干部腐敗案例的剖析,提出權(quán)力的集權(quán)式配置造成各權(quán)力主體的獨(dú)立性缺失、各權(quán)力主體之間缺乏分權(quán)制衡、各權(quán)力主體的權(quán)責(zé)不清和權(quán)力外部監(jiān)督弱化虛化等造成了權(quán)力制約監(jiān)督的缺失和高校行政權(quán)力的失范,甚至導(dǎo)致權(quán)力腐敗;谏鲜龈咝P姓䴔(quán)力控制機(jī)制的理論與現(xiàn)實(shí)分析,最后提出了完善分工合作、權(quán)責(zé)統(tǒng)一的行政班子內(nèi)部制約機(jī)制,健全校內(nèi)不同行政權(quán)力主體之間的權(quán)力制衡機(jī)制,建構(gòu)高校、教育部門、檢察機(jī)關(guān)之間的協(xié)同監(jiān)督機(jī)制和建立多方參與的全程監(jiān)督機(jī)制等重要對(duì)策。
[Abstract]:Colleges and universities are the subject of special administrative power authorized by the state law. In recent years, they have become an important research object of administrative management. Firstly, colleges and universities are subordinate to the government, and the government carries out administrative management on colleges and universities. This makes colleges and universities more closed than other administrative organs, easy to cause weak supervision; Secondly, the administrative and academic dualistic power structure in colleges and universities, and the administrative power subject has the dual identity of "control" and "service", forming a centralized management system, easy to lead to imbalance. Practice shows. Colleges and universities have become a new high incidence area of corruption crime, which is undoubtedly related to the defects of the administrative power control mechanism in colleges and universities, but there are few theoretical studies in this field at present. Under the background of comprehensively promoting the modernization of national governance system and governance ability, this paper studies the control mechanism of administrative power in colleges and universities. It has become an important topic which needs to be solved and has great practical significance. Based on the combing of relevant literature at home and abroad, this paper puts forward two kinds of control ways of administrative power: power restriction and power supervision, and from the relationship between subject and object of power. The power allocation mode, the power operation mechanism and the responsibility investigation form have compared the difference between the four aspects: the power restriction studies the power system internal strength, is a kind of bidirectional restraint and the restraint relation which takes the separation of powers as the premise. Because all the power subjects are involved in the whole process of power operation, they should bear the direct responsibility in the responsibility investigation. Power supervision studies the supervision and supervision of power subjects by external forces, which is a one-way relationship based on authorization, because it covers only one link in the process of power operation. Administrative power control in colleges and universities is a special form of power control, which is different from other administrative power control characteristics, after preliminary investigation. The article points out that the construction of administrative power restriction and power supervision in colleges and universities tends to be institutionalized, and the main body of supervision is diversified. Based on the analysis of the system of administrative control made by different institutions of higher learning, this paper points out the current administrative power restriction mechanism and administrative power supervision mechanism in colleges and universities. Based on the analysis of some cases of corruption of cadres in colleges and universities, the author points out that the centralization of power allocation results in the lack of independence of each power subject and the lack of separation of powers and checks and balances among the power subjects. The lack of power restriction supervision and the loss of administrative power in colleges and universities are caused by the unclear powers and responsibilities of the power subjects and the weakening of the power external supervision. Even lead to power corruption. Based on the above theoretical and practical analysis of the control mechanism of administrative power in colleges and universities, finally put forward a perfect division of work, the unity of power and responsibility of the internal control mechanism of the administrative team. It is necessary to perfect the power balance mechanism among different administrative power subjects, to construct the cooperative supervision mechanism among universities, educational departments and procuratorial organs, and to establish a multi-participation supervision mechanism in the whole process.
