【摘要】：預(yù)付式消費作為一種新型商業(yè)營銷模式,與傳統(tǒng)消費模式相比,其對消費者與經(jīng)營者都更為簡便、快捷。面對紛繁復(fù)雜的預(yù)付式消費市場、消費者權(quán)益受損情況不斷增多以及消費者維權(quán)困境等問題,預(yù)付式消費中消費者權(quán)益的法律保護亟待強化和健全。立足完善消費者權(quán)利和經(jīng)營者義務(wù),構(gòu)建相應(yīng)的監(jiān)管制度及多元化爭議解決機制,如完善團體訴訟制度,設(shè)立小額訴訟程序等,有利于更有效保障預(yù)付式消費健康有序的良性發(fā)展。在立法模式的選擇上,在時機成熟之際制定預(yù)付式消費的專門立法,以選擇"條例"的形式對其加以規(guī)制為較優(yōu)路徑。
[Abstract]:Prepaid consumption, as a new type of commercial marketing mode, is simpler and faster for both consumers and operators than the traditional consumption mode. In the face of complicated prepaid consumer market, the situation of consumer rights and interests is increasing, and the plight of consumer rights and interests, the legal protection of consumer rights and interests in prepaid consumption needs to be strengthened and improved. Based on the consummation of consumer rights and operators' obligations, the corresponding supervision system and diversified dispute resolution mechanism should be established, such as perfecting the system of group action, setting up small claims procedure, etc. It is beneficial to the healthy and orderly development of prepaid consumption. In the choice of legislative mode, the special legislation of prepaid consumption should be formulated at the ripe time, and the better way is to regulate it in the form of "regulations".
