【摘要】：預(yù)付式消費(fèi)作為一種新型商業(yè)營(yíng)銷模式,與傳統(tǒng)消費(fèi)模式相比,其對(duì)消費(fèi)者與經(jīng)營(yíng)者都更為簡(jiǎn)便、快捷。面對(duì)紛繁復(fù)雜的預(yù)付式消費(fèi)市場(chǎng)、消費(fèi)者權(quán)益受損情況不斷增多以及消費(fèi)者維權(quán)困境等問(wèn)題,預(yù)付式消費(fèi)中消費(fèi)者權(quán)益的法律保護(hù)亟待強(qiáng)化和健全。立足完善消費(fèi)者權(quán)利和經(jīng)營(yíng)者義務(wù),構(gòu)建相應(yīng)的監(jiān)管制度及多元化爭(zhēng)議解決機(jī)制,如完善團(tuán)體訴訟制度,設(shè)立小額訴訟程序等,有利于更有效保障預(yù)付式消費(fèi)健康有序的良性發(fā)展。在立法模式的選擇上,在時(shí)機(jī)成熟之際制定預(yù)付式消費(fèi)的專門(mén)立法,以選擇"條例"的形式對(duì)其加以規(guī)制為較優(yōu)路徑。
[Abstract]:Prepaid consumption, as a new type of commercial marketing mode, is simpler and faster for both consumers and operators than the traditional consumption mode. In the face of complicated prepaid consumer market, the situation of consumer rights and interests is increasing, and the plight of consumer rights and interests, the legal protection of consumer rights and interests in prepaid consumption needs to be strengthened and improved. Based on the consummation of consumer rights and operators' obligations, the corresponding supervision system and diversified dispute resolution mechanism should be established, such as perfecting the system of group action, setting up small claims procedure, etc. It is beneficial to the healthy and orderly development of prepaid consumption. In the choice of legislative mode, the special legislation of prepaid consumption should be formulated at the ripe time, and the better way is to regulate it in the form of "regulations".
