【摘要】：隨著經(jīng)濟(jì)全球化發(fā)展和互聯(lián)網(wǎng)應(yīng)用普及，以互聯(lián)網(wǎng)絡(luò)為載體的經(jīng)濟(jì)交易活動(dòng)大量涌現(xiàn)，這一新興經(jīng)濟(jì)形式—網(wǎng)絡(luò)經(jīng)濟(jì)，因其巨大的成長空間和市場潛力，引起社會(huì)各界的重點(diǎn)關(guān)注。然而，網(wǎng)絡(luò)交易具有的環(huán)境開放、主體虛擬化、行為隱蔽和方式多變等特點(diǎn)，因而也滋生了數(shù)量龐大形式繁多的網(wǎng)絡(luò)經(jīng)濟(jì)違法行為，這日漸成為嚴(yán)重的社會(huì)問題。2010年互聯(lián)網(wǎng)服務(wù)投訴量上升了68.7%，2011年我國超過8%網(wǎng)民遇到過網(wǎng)上消費(fèi)欺詐。我國傳統(tǒng)的監(jiān)管規(guī)制在解決3Q大戰(zhàn)、淘寶新規(guī)等網(wǎng)絡(luò)群體事件時(shí)顯得捉襟見肘。那么，是什么因素影響和決定著網(wǎng)絡(luò)經(jīng)濟(jì)違法的有效監(jiān)管呢？如何創(chuàng)新網(wǎng)絡(luò)經(jīng)濟(jì)監(jiān)管模式，保障公平競爭的社會(huì)主義網(wǎng)絡(luò)經(jīng)濟(jì)市場秩序？對(duì)這些問題做出回答，需要對(duì)網(wǎng)絡(luò)經(jīng)濟(jì)違法監(jiān)管的影響因素及其作用機(jī)理進(jìn)行深入研究。為此，本文做了如下研究： ①分析影響網(wǎng)絡(luò)經(jīng)濟(jì)違法監(jiān)管的要素，對(duì)影響要素的作用機(jī)理進(jìn)行深入探索。 本文從管理學(xué)、信息經(jīng)濟(jì)學(xué)、行政法學(xué)等交叉學(xué)科角度，結(jié)合我國網(wǎng)絡(luò)經(jīng)濟(jì)違法監(jiān)管現(xiàn)狀和近10年的CNKI網(wǎng)相關(guān)研究文獻(xiàn)，系統(tǒng)深入地分析影響網(wǎng)絡(luò)經(jīng)濟(jì)違法監(jiān)管的要素，對(duì)影響要素的作用機(jī)理進(jìn)行定量研究和數(shù)量刻畫。提出網(wǎng)絡(luò)經(jīng)濟(jì)違法監(jiān)管的主要影響要素：政府監(jiān)管機(jī)構(gòu)（監(jiān)管主體）、網(wǎng)絡(luò)經(jīng)營群體（監(jiān)管客體）、網(wǎng)絡(luò)交易平臺(tái)和政府監(jiān)管網(wǎng)。 ②分析網(wǎng)絡(luò)交易中監(jiān)管主客體博弈特征，對(duì)主客體的成本效益進(jìn)行數(shù)量刻畫。 本文結(jié)合我國當(dāng)前網(wǎng)絡(luò)經(jīng)濟(jì)運(yùn)行的現(xiàn)實(shí)情況，引入有限理性理論，采用進(jìn)化博弈方法模擬監(jiān)管主體、客體之間的利益均衡，找出網(wǎng)絡(luò)經(jīng)濟(jì)違法監(jiān)管中影響雙方相互作用的主要因素。研究結(jié)果表明，國家可給予相關(guān)監(jiān)管機(jī)構(gòu)專項(xiàng)補(bǔ)貼；增強(qiáng)違法經(jīng)營行為對(duì)社會(huì)、政府負(fù)效應(yīng)的影響程度；應(yīng)增大網(wǎng)絡(luò)經(jīng)營者違法經(jīng)營的查處罰金；大力推行國家項(xiàng)目資金向企業(yè)的傾斜力度。 ③分析網(wǎng)絡(luò)經(jīng)濟(jì)違法的監(jiān)管主體工作方式，構(gòu)建了政府的“T周期”監(jiān)管模式。 本文針對(duì)我國相關(guān)監(jiān)管機(jī)構(gòu)對(duì)網(wǎng)絡(luò)交易違法行為的具體監(jiān)管流程，設(shè)計(jì)了一種“T周期”的循環(huán)監(jiān)管機(jī)制，研究采用馬爾可夫鏈，計(jì)算出n階段博弈之后的策略組合概率分布，實(shí)現(xiàn)預(yù)測(cè)網(wǎng)絡(luò)交易監(jiān)管策略組合的走向，并通過仿真論證了“T周期”監(jiān)管機(jī)制的科學(xué)性。監(jiān)管機(jī)構(gòu)在采用“T期”監(jiān)管期的監(jiān)管方式后，能夠?qū)崿F(xiàn)加強(qiáng)對(duì)違法主體的信息傳遞，提高{監(jiān)管，，不違法}策略組合出現(xiàn)的概率。 ④系統(tǒng)分析網(wǎng)絡(luò)空間的經(jīng)濟(jì)活動(dòng)規(guī)律,構(gòu)建了網(wǎng)絡(luò)經(jīng)濟(jì)違法的技術(shù)監(jiān)管模型。 本文基于網(wǎng)絡(luò)平臺(tái)特征，以網(wǎng)絡(luò)經(jīng)濟(jì)違法案件為主要研究對(duì)象，建立網(wǎng)絡(luò)經(jīng)濟(jì)違法監(jiān)管各要素相互作用的系統(tǒng)動(dòng)力學(xué)模型，仿真結(jié)果顯示監(jiān)管技術(shù)研發(fā)投入能夠有效提升監(jiān)管效率。根據(jù)研究結(jié)論構(gòu)建了“以網(wǎng)管網(wǎng)”的網(wǎng)絡(luò)經(jīng)濟(jì)違法的技術(shù)監(jiān)管模型，模型由電子商務(wù)經(jīng)營主體模塊、電子商務(wù)監(jiān)管服務(wù)網(wǎng)模塊、網(wǎng)絡(luò)廣告智能監(jiān)測(cè)平臺(tái)、電子商務(wù)搜索監(jiān)測(cè)平臺(tái)、電子證據(jù)采集平臺(tái)等五大模塊構(gòu)成。該網(wǎng)絡(luò)經(jīng)濟(jì)違法技術(shù)監(jiān)管模型在***市工商局電子商務(wù)監(jiān)管和***市級(jí)電子數(shù)據(jù)取證實(shí)驗(yàn)室中得到應(yīng)用。

However, the network transaction has the characteristics of environment opening, main body virtualization, hidden and changeable behavior and so on, thus also breeding a large number of network economic violations, which is becoming a serious social problem. This paper, from the cross-disciplinary angle of management, information economics and administrative law, combined with the current situation of network economic and illegal regulation of our country and the relevant research literature of CNKI network in the last 10 years, the system deeply analyses the illegal regulation of the network economy.
