【摘要】:醫(yī)療衛(wèi)生事業(yè)關(guān)乎億萬(wàn)人民的生命健康,是一個(gè)極其重大又老生常談的民生問(wèn)題。隨著改革的不斷深入,國(guó)有醫(yī)療機(jī)構(gòu)因其性質(zhì)的特殊,導(dǎo)致一些全新的深層次矛盾逐漸顯現(xiàn)。近年來(lái),我國(guó)逐漸加大對(duì)醫(yī)藥購(gòu)銷領(lǐng)域賄賂犯罪的打擊力度,對(duì)于國(guó)有醫(yī)療機(jī)構(gòu)信息管理人員等新型行為主體,私下收受醫(yī)藥銷售人員好處費(fèi),利用職務(wù)便利,,為其提供臨床用藥量信息的行為,究竟應(yīng)該按照受賄罪論處還是以非國(guó)家工作人員受賄罪定罪量刑,司法實(shí)踐中莫衷一是。 在受賄罪的認(rèn)定過(guò)程中,主體資格是最為重要的衡量標(biāo)準(zhǔn)之一。對(duì)于國(guó)家工作人員身份的認(rèn)定,刑法理論界曾出現(xiàn)過(guò)四種不同的觀點(diǎn):?jiǎn)挝恍再|(zhì)說(shuō)、財(cái)產(chǎn)性質(zhì)說(shuō)、身份說(shuō)和公務(wù)說(shuō)。種種學(xué)說(shuō)雖各執(zhí)己見(jiàn),但總不能盡善盡美,許多內(nèi)容有待于進(jìn)一步的修正和完善。由于最高人民法院、最高人民檢察院關(guān)于“國(guó)家工作人員”認(rèn)定標(biāo)準(zhǔn)的司法解釋側(cè)重點(diǎn)不同,以及兜底性條款的概括性與模糊性,為基層法院的判案帶來(lái)不小困擾。 針對(duì)這一問(wèn)題,筆者發(fā)現(xiàn)司法實(shí)踐中受賄主體范圍的認(rèn)定標(biāo)準(zhǔn)呈現(xiàn)出由不斷擴(kuò)張到逐漸收縮,再到又一次擴(kuò)大的趨勢(shì),而這種變化趨勢(shì)是由于社會(huì)生活的不停變革,刑事政策也發(fā)生著相應(yīng)的更替。刑事政策指引著刑事立法與刑法變革,在社會(huì)大力提倡和諧理念的環(huán)境下,“寬嚴(yán)相濟(jì)”的刑事政策要求我們?cè)诿鎸?duì)復(fù)雜的犯罪現(xiàn)象前,秉承以最小的刑罰量獲取最大的刑法效益的理念,盡可能地減少社會(huì)消極因素,立足于解放及更新人的本質(zhì)的回歸,從根本上改變錯(cuò)誤的重刑思想。 結(jié)合筆者收集的相關(guān)判決,我們不難發(fā)現(xiàn)目前受賄主體資格認(rèn)定的標(biāo)準(zhǔn)存在種種誤解和弊端,無(wú)法很好地解決類似國(guó)有醫(yī)療機(jī)構(gòu)信息管理人員等主體的認(rèn)定問(wèn)題。因此,筆者以刑法解釋方法為探索路徑,結(jié)合具體案件,從醫(yī)院的收入來(lái)源及藥品購(gòu)銷流程入手,將網(wǎng)絡(luò)信息管理人員的行為放在整個(gè)受賄過(guò)程中加以考察,立足于刑法解釋學(xué)與實(shí)證研究,期望對(duì)非國(guó)家工作人員的主體資格認(rèn)定進(jìn)行更為深入的探討與學(xué)習(xí),試圖尋求受賄主體的全新認(rèn)定標(biāo)準(zhǔn),以有效解決現(xiàn)實(shí)紛爭(zhēng)問(wèn)題,見(jiàn)益于日后的司法實(shí)踐領(lǐng)域。
[Abstract]:Medical and health care is a vital and commonplace issue to the lives and health of hundreds of millions of people. With the deepening of reform, state-owned medical institutions, because of its special nature, lead to some new deep-seated contradictions gradually appear. In recent years, our country has gradually stepped up its crackdown on bribery crimes in the field of pharmaceutical purchase and marketing. For new types of behavior subjects such as information managers in state-owned medical institutions, they receive benefit fees from pharmaceutical sales personnel in private and make use of their position to facilitate them. In judicial practice, the behavior of providing clinical drug quantity information should be punished according to the crime of bribery or the conviction and sentencing of the crime of accepting bribes by non-state functionaries. Subject qualification is one of the most important standards in the determination of bribery crime. There are four different views on the identification of state functionaries: unit nature, property nature, identity and official duties. Although various theories hold their own opinions, they are not perfect, and many contents need to be further revised and perfected. As the Supreme people's Court and the Supreme people's Procuratorate put different emphasis on the judicial interpretation of the standards for the identification of "state functionaries", and the generality and fuzziness of the underlying clauses, it has caused a great deal of trouble for the basic courts to adjudicate cases. In order to solve this problem, the author finds that in judicial practice, the criteria for the determination of the scope of the subject of bribery show a trend of expansion from constant expansion to gradual contraction, and then to another expansion, and this trend of change is due to the constant changes in social life. There is also a corresponding change in criminal policy. Criminal policy guides the reform of criminal legislation and criminal law. Under the environment of promoting the concept of harmony in society, the criminal policy of "combining leniency with severity" requires us to face the complex crime phenomenon. Adhering to the idea of obtaining the maximum benefit of criminal law with the minimum amount of penalty, reducing negative social factors as far as possible, basing on the return of emancipation and renewal of human essence, changing the wrong thought of heavy punishment fundamentally. Combined with the relevant judgments collected by the author, it is not difficult to find that there are various misunderstandings and drawbacks in the criteria of the qualification of the subject of bribery at present, which can not solve the problem of the identification of the subject such as the information manager of the state-owned medical institution. Therefore, the author takes the criminal law interpretation method as the exploration path, unifies the concrete case, starts from the hospital income source and the drug purchase and sale flow, will network information management personnel behavior in the entire bribery process to investigate. Based on the hermeneutics of criminal law and empirical research, the author hopes to explore and study the subject qualification of non-state staff more deeply, and try to seek a new standard for the subject of bribery, in order to effectively solve the actual dispute. This is beneficial to the field of judicial practice in the future.
