【摘要】：國家推出"1+6"生態(tài)文明改革組合拳,其中《生態(tài)環(huán)境損害賠償制度改革試點方案》明確了到2020年力爭初步構(gòu)建責(zé)任明確、途徑暢通、技術(shù)規(guī)范、保障有力、賠償?shù)轿�、修�?fù)有效的生態(tài)環(huán)境損害賠償制度。京津冀協(xié)同發(fā)展是一項重大國家戰(zhàn)略,其戰(zhàn)略的核心是有序疏解北京非首都功能。在疏解和承接過程中必定會產(chǎn)生對生態(tài)環(huán)境的損壞,這就涉及生態(tài)環(huán)境損壞賠償問題。文章在有選擇地分析了北京畜牧業(yè)和制造業(yè)功能疏解對生態(tài)環(huán)境造成的影響后,探索了非首都功能疏解生態(tài)環(huán)境損害賠償制度,包括賠償原則、建立第三方鑒定評估機構(gòu)、評估指標體系及其環(huán)境損失的測算。提出保障非首都功能疏解生態(tài)環(huán)境損害賠償運行機制,包括生態(tài)環(huán)境論證機制、生態(tài)環(huán)境稅費征收機制、政策統(tǒng)領(lǐng)導(dǎo)向機制。
[Abstract]:The state launched the "16" ecological civilization reform combination fist, in which the pilot scheme of ecological environment damage compensation system reform made it clear that by 2020, the primary construction responsibility is clear, the way is clear, the technical standard is strong, the guarantee is strong, the compensation is in place, and the effective ecological environment damage compensation system is repaired. The coordinated development of Beijing, Tianjin and Hebei is an important national strategy, the core of which is to dredge the function of Beijing's non-capital in an orderly manner. In the process of dredging and undertaking, there will certainly be damage to the ecological environment, which involves the problem of compensation for the damage of the ecological environment. After selectively analyzing the influence of functional thinning of animal husbandry and manufacturing industry in Beijing on ecological environment, this paper explores the compensation system of ecological environment damage caused by non-capital function dredging, including the principle of compensation, the establishment of third party appraisal and evaluation organization, the evaluation index system and the calculation of environmental loss. This paper puts forward the operation mechanism of protecting the non-capital function to relieve the ecological environment damage compensation, including the ecological environment demonstration mechanism, the ecological environment tax and fee collection mechanism, and the policy guidance mechanism.
