我國政府食品安全監(jiān)管的角色研究

【摘要】:隨著經(jīng)濟的快速發(fā)展和社會的不斷進(jìn)步,我國食品市場呈現(xiàn)出一片紛繁復(fù)雜的景象,食品的種類之多、數(shù)量之大都彰顯著食品市場的繁榮,在如此多樣化的食品中如何保證食品的安全性成為全社會共同關(guān)注的焦點。食品安全關(guān)系著民眾的身體健康和生命安全,更關(guān)系著社會的穩(wěn)定和國家的發(fā)展,但頻繁發(fā)生的食品安全事件使得公眾對于食品市場和政府監(jiān)管能力越來越失去信心。因此,當(dāng)前我國食品安全監(jiān)管模式已不再適應(yīng)食品市場的飛速發(fā)展,必須進(jìn)一步完善。2013年3月,第十二屆全國人民代表大會啟動,“食品安全”作為重要的熱點問題之一,成為政府工作中亟待解決的重大問題,為了更好地實現(xiàn)食品安全監(jiān)管,新的機構(gòu)改革方案中對食品安全監(jiān)管機構(gòu)和職能又一次進(jìn)行了重大地調(diào)整,隨后在2013年5月15日,中央機構(gòu)編制委員會辦公室公布了食品藥品監(jiān)督管理總局的“三定方案”,隨著其職能逐步浮出水面,此次食品安全監(jiān)管機構(gòu)和職能的重大調(diào)整也有了更為明確的方向。 本文引用社會學(xué)中“角色理論”的四個層面,即角色期待、角色扮演、角色失調(diào)和角色整合作為分析框架,對政府在食品安全監(jiān)管中的角色進(jìn)行深入、詳細(xì)的分析。從角色期待層面闡述了我國政府在食品安全監(jiān)管中存在的必要性,以角色扮演中角色定位和角色實踐兩個角度為切入點,闡述了我國政府在食品安全監(jiān)管中扮演什么樣的角色--立法者和執(zhí)法者,然后以“三聚氰胺奶粉”事件為主要案例,分析了我國政府食品安全監(jiān)管中在立法角色和執(zhí)法角色中存在的問題,并挖掘其原因。最后結(jié)合國際先進(jìn)的政府食品安全監(jiān)管經(jīng)驗,從角色意識、角色重建、角色讓渡三個層面對我國食品安全監(jiān)管的未來走勢和發(fā)展方向提出了建議。
[Abstract]:With the rapid development of economy and the continuous progress of society, the food market of our country presents a complicated scene, the variety of food and the quantity of food show the prosperity of food market. In such a variety of foods, how to ensure the safety of food has become the focus of attention of the whole society. Food safety is related to the health and safety of the people, the stability of the society and the development of the country. However, the frequent food safety incidents make the public lose more and more confidence in the food market and the ability of government supervision. Therefore, the current mode of food safety supervision in China is no longer adapted to the rapid development of the food market and must be further improved. In March 2013, the 12th National people's Congress started, "Food Safety" as one of the important hot issues. To become a major issue to be addressed in the work of the Government, and in order to better achieve food safety regulation, the new institutional reform programme has once again made significant adjustments to the food safety regulatory bodies and functions, and subsequently on 15 May 2013, The Office of the Central Organization Establishment Committee announced the "three plans" of the Food and Drug Administration. As its functions gradually surfaced, the major readjustment of the food safety regulatory bodies and functions also took a clearer direction. This paper uses the four levels of "role theory" in sociology, that is, role expectation, role playing, role imbalance and role integration, as an analytical framework, and makes a thorough and detailed analysis of the role of the government in food safety supervision. This paper expounds the necessity of Chinese government in food safety supervision from the perspective of role expectation, and takes the role orientation and role practice as the starting point. This paper expounds what role our government plays in food safety supervision-legislators and law enforcers, and then takes the incident of "melamine milk powder" as the main case. This paper analyzes the problems existing in the role of legislation and law enforcement in the food safety supervision of our government, and excavates the reasons. Finally, combined with the international advanced experience of government food safety supervision, this paper puts forward some suggestions on the future trend and development direction of food safety supervision in China from the following three aspects: role consciousness, role reconstruction and role transfer.
