我國(guó)食品安全監(jiān)管的整合與協(xié)同體制構(gòu)建研究

【摘要】:近幾年以來(lái),中國(guó)食品安全事件的頻發(fā)、升級(jí),成為公共安全中的一個(gè)極為突出的問(wèn)題,公眾將輿論的矛頭指向了食品安全監(jiān)管體制。以政府為主體的單一、分階段監(jiān)管模式使得政府食品安全監(jiān)管體制中存在監(jiān)管職能分散,監(jiān)管主體力量薄弱等問(wèn)題,整體上呈現(xiàn)碎片化局面,這是導(dǎo)致我國(guó)食品安全問(wèn)題發(fā)生的主要原因之一。對(duì)于監(jiān)管的碎片化,,需要通過(guò)職能的整合、監(jiān)管主體的協(xié)同來(lái)解決。盡管中國(guó)政府針對(duì)監(jiān)管的碎片化問(wèn)題,試圖做出過(guò)一些職能上的調(diào)整,但是其改革的進(jìn)展遲緩、成效甚微。2012年6月23日,國(guó)務(wù)院提出了階段性的食品安全監(jiān)管目標(biāo),預(yù)計(jì)用3至5年的時(shí)間,大力整治食品安全監(jiān)管工作中的不良行為,能夠有效治理違法犯罪。這一目標(biāo)的制定,對(duì)如何優(yōu)化我國(guó)食品安全監(jiān)管職能,完善食品安全監(jiān)管體制提出了嚴(yán)峻的考驗(yàn)。在當(dāng)前食品安全背景下,完善我國(guó)食品安全監(jiān)管體制,促進(jìn)監(jiān)管職能的整合與監(jiān)管主體的協(xié)同頗為重要。 整體性治理、協(xié)同治理是現(xiàn)代政府管理的特點(diǎn)和發(fā)展趨勢(shì)。我國(guó)食品安全監(jiān)管體制的缺陷以及完善路徑,產(chǎn)生了對(duì)整體性治理理論和協(xié)同理論的需求;谥袊(guó)政府在食品安全監(jiān)管職能上的多元主體分析,用整合、協(xié)同策略來(lái)解決監(jiān)管職能中存在的碎片化問(wèn)題,從理論上講是兩大治理理論的基本要求。 本文以整體性治理、協(xié)同治理理論作為依據(jù),對(duì)我國(guó)食品安全監(jiān)管體制存在的問(wèn)題及其成因進(jìn)行分析,通過(guò)學(xué)習(xí)借鑒國(guó)外食品安全監(jiān)管經(jīng)驗(yàn),對(duì)食品安全監(jiān)管職能整合、政府監(jiān)管與社會(huì)監(jiān)督協(xié)同參與以及不同層級(jí)政府間復(fù)雜的監(jiān)管與協(xié)調(diào)關(guān)系問(wèn)題等進(jìn)行深層次剖析,探索完善我國(guó)食品安全監(jiān)管體制的對(duì)策,為實(shí)現(xiàn)我國(guó)政府食品安全有效監(jiān)管提出初步設(shè)想和建議。
[Abstract]:In recent years, the frequent occurrence and escalation of food safety incidents in China has become an extremely prominent problem in public safety, and the public opinion has pointed the spearhead of public opinion at the food safety supervision system. With the government as the main body of a single, phased supervision mode, the government food safety supervision system has problems such as decentralized supervision function, weak supervision body, and so on, which presents a fragmented situation. This is one of the main causes of food safety problems in China. The fragmentation of supervision needs to be solved through the integration of functions and the coordination of regulatory bodies. Although the Chinese government has tried to make some functional adjustments to the fragmented issue of regulation, its reform has been slow and has had little effect. On June 23, 2012, the State Council proposed a phased target for food safety regulation. It is estimated that it will take 3 to 5 years to crack down on the bad behavior in the food safety supervision and control effectively. The formulation of this goal puts forward a severe test on how to optimize the function of food safety supervision and improve the food safety supervision system. Under the background of current food safety, it is very important to perfect the supervision system of food safety in our country, and to promote the integration of the supervision function and the coordination of the main body of supervision. Overall governance, collaborative governance is the characteristics and development trend of modern government management. The defects of food safety supervision system in China and the ways to improve the system have brought about the demand for the theory of holistic governance and the theory of coordination. Based on the multi-subject analysis of the Chinese government's function of food safety supervision, it is theoretically the basic requirement of the two governance theories to solve the fragmentation problem in the regulatory function by means of integration and coordination strategy. Based on the theory of holistic governance and cooperative governance, this paper analyzes the problems and causes of food safety supervision system in China, and integrates the functions of food safety supervision by learning from the experience of foreign food safety supervision. The coordination participation of government supervision and social supervision and the complicated supervision and coordination relationship between governments at different levels are deeply analyzed in order to explore the countermeasures to perfect the food safety supervision system in China. In order to realize the effective supervision of food safety in our country, the tentative ideas and suggestions are put forward.
