超高壓輸電線路工程建設(shè)合同管理研究

【摘要】:電力工程施工合同是電力企業(yè)市場(chǎng)化運(yùn)作的基礎(chǔ),對(duì)施工合同進(jìn)行有效管理是確保輸電工程建設(shè)質(zhì)量的重要手段。在對(duì)外經(jīng)濟(jì)活動(dòng)中,基層電力企業(yè)單位負(fù)責(zé)人不善于依法決策、維護(hù)自身合法權(quán)益,很可能導(dǎo)致企業(yè)承受不必要的經(jīng)濟(jì)損失。因此,對(duì)電力合同管理風(fēng)險(xiǎn)加強(qiáng)控制不但是國(guó)內(nèi)市場(chǎng)經(jīng)濟(jì)發(fā)展、電力體制改革的趨勢(shì),也是企業(yè)內(nèi)部提升風(fēng)險(xiǎn)管控水平的必經(jīng)之路。 合同管理工作涉及超高壓輸電線路電力工程項(xiàng)目管理的各個(gè)方面,每環(huán)節(jié)都要充分重視。本文主要從發(fā)包方的角度分析了輸電線路工程項(xiàng)目中的合同管理過(guò)程,對(duì)貫穿于工程建設(shè)全過(guò)程的各個(gè)合同管理環(huán)節(jié)進(jìn)行了清晰的描述,指出項(xiàng)目管理工作的重心是合同管理。同時(shí)在對(duì)超高壓電力合同管理現(xiàn)狀進(jìn)行分析的基礎(chǔ)上,依據(jù)現(xiàn)行法律法規(guī)和實(shí)踐中積累的一些經(jīng)驗(yàn),運(yùn)用現(xiàn)代工程管理知識(shí)和信息管理技術(shù),提出如何對(duì)輸電線路工程建設(shè)合同進(jìn)行系統(tǒng)管理。研究重點(diǎn)放在合同管理內(nèi)部控制中可能存在的不足,進(jìn)而對(duì)風(fēng)險(xiǎn)點(diǎn)進(jìn)行梳理歸納,提出合同管理的優(yōu)化方案。該優(yōu)化方案統(tǒng)籌考慮企業(yè)內(nèi)部各項(xiàng)業(yè)務(wù)部門(mén)之間的聯(lián)系,通過(guò)梳理合同管理流程,規(guī)范合同簽訂和履行,結(jié)合信息管理系統(tǒng)的技術(shù)支持,不斷提升合同風(fēng)險(xiǎn)的防范能力。最后結(jié)合作者的實(shí)際工作經(jīng)驗(yàn),闡述在某超高壓公司輸電線路項(xiàng)目合同管理工作中的治理對(duì)策,強(qiáng)調(diào)全面發(fā)揮內(nèi)部審計(jì)的作用,促進(jìn)企業(yè)制度健全和合同管理內(nèi)部控制完善,希望達(dá)到降低合同風(fēng)險(xiǎn),提高合同履行效率的目的。
[Abstract]:The construction contract of electric power engineering is the basis of the market-oriented operation of electric power enterprise. The effective management of construction contract is an important means to ensure the construction quality of transmission project. In foreign economic activities, the responsible persons of grass-roots electric power enterprises are not good at making decisions according to law and safeguarding their own legitimate rights and interests, which may lead to unnecessary economic losses. Therefore, strengthening the control of power contract management risk is not only the trend of the development of the domestic market economy and the reform of the electric power system, but also the only way to enhance the risk control level within the enterprise. Contract management involves all aspects of EHV transmission line power project management. This paper mainly analyzes the contract management process in transmission line project from the point of view of the contracting party, describes clearly the various contract management links running through the whole process of the project construction, and points out that the focus of the project management work is the contract management. At the same time, on the basis of analyzing the current situation of the management of EHV electric power contract, and according to the existing laws and regulations and some experiences accumulated in practice, using modern engineering management knowledge and information management technology, This paper puts forward how to manage the construction contract of transmission line project systematically. The research focuses on the possible deficiencies in the internal control of contract management, and then combs and summarizes the risk points, and puts forward the optimization scheme of contract management. Through combing the contract management process, standardizing the contract signing and performing, and combining the technical support of the information management system, the optimization plan continuously improves the ability of preventing contract risk. Finally, combined with the author's practical work experience, this paper expounds the management countermeasures in the contract management of an EHV transmission line project, emphasizes the role of internal audit, and promotes the perfection of the enterprise system and the internal control of the contract management. We hope to reduce the risk of contract and improve the efficiency of contract performance.
