惠州市食品生產(chǎn)質(zhì)量監(jiān)管機(jī)制研究

【摘要】:隨著我國經(jīng)濟(jì)社會(huì)的快速發(fā)展,人民生活水平的不斷提高,百姓逐漸由滿足溫飽向追求質(zhì)量轉(zhuǎn)變。但是近年來,一系列惡性食品安全事件接連不斷發(fā)生,嚴(yán)重影響百姓生產(chǎn)生活以及社會(huì)和諧穩(wěn)定。為維護(hù)社會(huì)秩序,還百姓良好生存環(huán)境,穩(wěn)定食品安全態(tài)勢,在食品工業(yè)化時(shí)代,必須確保食品生產(chǎn)質(zhì)量安全,必須提高政府對食品生產(chǎn)企業(yè)的監(jiān)督管理能力。這些年,惠州市政府加大力度整治食品質(zhì)量安全事件,尤其強(qiáng)調(diào)對于食品生產(chǎn)質(zhì)量的保障,但是在治理過程中出現(xiàn)信息傳輸不順暢、疏忽對消費(fèi)者的引導(dǎo)、法律法規(guī)未貫徹執(zhí)行、宣傳方式單一、缺乏權(quán)利監(jiān)督制約等問題,食品安全監(jiān)管機(jī)制運(yùn)行不暢,整治成效難以顯現(xiàn)。因此,惠州市政府如何完善食品生產(chǎn)質(zhì)量監(jiān)管機(jī)制,提升監(jiān)管成效,提高食品安全水平,是當(dāng)前亟需解決的難題。 本文在政府規(guī)制的框架下研究如何完善惠州市食品生產(chǎn)質(zhì)量監(jiān)管機(jī)制的問題,,以數(shù)量占絕大多數(shù)的小微型食品生產(chǎn)企業(yè)為研究對象,提出政府要建立公開透明、配套完善、監(jiān)督得當(dāng)?shù)谋O(jiān)管機(jī)制的目標(biāo)。本文首先界定了食品質(zhì)量安全、監(jiān)管機(jī)制、食品生產(chǎn)質(zhì)量監(jiān)管機(jī)制等概念,借助公共利益理論、政府規(guī)制理論以及政府管制俘獲理論等作為解決食品安全監(jiān)管的理論依據(jù),并指出完善監(jiān)管機(jī)制的必要性;在綜合學(xué)習(xí)、探討、借鑒國內(nèi)外政府的優(yōu)秀經(jīng)驗(yàn)與成功做法的基礎(chǔ)上,提煉貼合惠州實(shí)際的應(yīng)對措施。為提出針對性建議,本文詳細(xì)描述惠州市食品生產(chǎn)質(zhì)量監(jiān)管現(xiàn)狀,結(jié)合典型事例對問題及原因深入分析,根據(jù)當(dāng)?shù)貙?shí)際,制定出完善惠州市食品生產(chǎn)質(zhì)量監(jiān)管機(jī)制的對策建議,完善信息公開機(jī)制,如構(gòu)建食品安全信息共享平臺(tái)、豐富政府信息公開內(nèi)容、督促食品生產(chǎn)企業(yè)信息公開;完善依法治理機(jī)制,如提升地方法規(guī)可操作性、樹立依法治理理念、強(qiáng)化法律法規(guī)執(zhí)行力度;完善監(jiān)督問責(zé)機(jī)制,如建立公眾監(jiān)督機(jī)制、加強(qiáng)輿論監(jiān)督機(jī)制、落實(shí)監(jiān)管問責(zé)機(jī)制。
[Abstract]:With the rapid development of our country's economy and society and the improvement of people's living standard, the people gradually change from satisfying food and clothing to pursuing quality. However, in recent years, a series of malignant food safety incidents continue to occur, seriously affecting the production and life of the people and social harmony and stability. In order to maintain social order, give people a good living environment and stabilize the situation of food safety, in the era of food industrialization, it is necessary to ensure the quality and safety of food production and to improve the ability of the government to supervise and manage food production enterprises. In recent years, the Huizhou Municipal Government has stepped up efforts to rectify food quality and safety incidents, with particular emphasis on ensuring the quality of food production. However, in the process of governance, information transmission is not smooth and consumers are negligently guided. The laws and regulations have not been carried out, the propaganda way is single, the rights supervision and restriction are lacking, the food safety supervision mechanism is not running smoothly, and the effect of regulation is difficult to show. Therefore, how to improve the quality of food production supervision mechanism, improve the effectiveness of supervision, improve the level of food safety, is the urgent need to solve the problem. Under the framework of government regulation, this paper studies how to improve the supervision mechanism of food production quality in Huizhou City. Taking the small and micro food production enterprises which account for the vast majority of the quantity as the research object, the paper puts forward that the government should establish the open and transparent, complete set of perfect food production. The objective of a properly supervised regulatory mechanism. Firstly, this paper defines the concepts of food quality and safety, supervision mechanism, food production quality supervision mechanism and so on. With the help of the theory of public interest, the theory of government regulation and the theory of government control capture, etc., as the theoretical basis to solve the problem of food safety supervision. It also points out the necessity of perfecting the supervision mechanism, and on the basis of comprehensive study, discussion, and drawing lessons from the excellent experiences and successful practices of the domestic and foreign governments, refines the practical countermeasures in Huizhou. In order to put forward some specific suggestions, this paper describes the current situation of food production quality supervision in Huizhou in detail, analyzes the problems and causes in combination with typical examples, and formulates the countermeasures and suggestions to improve the supervision mechanism of food production quality in Huizhou according to the local reality. To improve the mechanism of information disclosure, such as building food safety information sharing platform, enriching the contents of government information disclosure, urging food production enterprises to open information, perfecting the mechanism of governing according to law, such as enhancing the operability of local laws and regulations, and establishing the concept of governing according to law, Strengthening the enforcement of laws and regulations, perfecting the supervision and accountability mechanism, such as establishing the public supervision mechanism, strengthening the supervision mechanism of public opinion, and implementing the supervision and accountability mechanism.
