專利視角下的智能手機(jī)競(jìng)爭(zhēng)態(tài)勢(shì)研究

【摘要】:智能手機(jī)的技術(shù)競(jìng)爭(zhēng)與發(fā)展速度日益加快,專利訴訟已經(jīng)成為移動(dòng)手機(jī)行業(yè)的普遍特征。回顧歷史,這種訴訟更趨向于關(guān)注諸如無(wú)線電傳輸、網(wǎng)絡(luò)管理和語(yǔ)言壓縮技術(shù)等領(lǐng)域中提供傳統(tǒng)移動(dòng)語(yǔ)音服務(wù)的核心技術(shù)。最近,智能手機(jī)領(lǐng)域的訴訟,不斷向更大的技術(shù)范圍拓展,也產(chǎn)生了新的技術(shù)紛爭(zhēng)。文章從專利的視角,結(jié)合專利計(jì)量與專利引文分析的方法,透過訴訟專利來(lái)分析當(dāng)下智能手機(jī)的競(jìng)爭(zhēng)狀態(tài),并窺探智能手機(jī)的未來(lái)競(jìng)爭(zhēng)趨勢(shì)。 文章以德溫特專利數(shù)據(jù)庫(kù)中的專利數(shù)據(jù)為基礎(chǔ),結(jié)合收集整理的智能手機(jī)訴訟案中的被訴訟專利,通過對(duì)智能手機(jī)領(lǐng)域?qū)@闹笜?biāo)計(jì)量,利用信息可視化的技術(shù),對(duì)智能手機(jī)的技術(shù)競(jìng)爭(zhēng)狀態(tài)進(jìn)行分析與描述。同時(shí),選取智能手機(jī)領(lǐng)域六大手機(jī)生產(chǎn)廠商,從專利申請(qǐng)數(shù)量以及專利被引頻次兩方面進(jìn)行專利技術(shù)的比較,確定智能手機(jī)企業(yè)在不同技術(shù)領(lǐng)域中的地位。利用智能手機(jī)被訴訟的專利形成的專利引文網(wǎng)絡(luò),進(jìn)一步確定智能手機(jī)領(lǐng)域?qū)@V訟關(guān)注的焦點(diǎn)技術(shù)領(lǐng)域及核心專利。 結(jié)果顯示,智能手機(jī)領(lǐng)域的專利數(shù)量成逐年迅速增長(zhǎng)的趨勢(shì),且主要的專利權(quán)人,絕大部分為當(dāng)下智能手機(jī)市場(chǎng)中的主要手機(jī)生產(chǎn)廠商。而智能手機(jī)企業(yè)間的專利申請(qǐng)數(shù)量和專利被引頻次有較大差距,綜合兩項(xiàng)指標(biāo),蘋果公司雖然專利數(shù)量并不占據(jù)大多數(shù),但其以高H指數(shù)和高被引頻次,成為智能手機(jī)領(lǐng)域舉足輕重的技術(shù)競(jìng)爭(zhēng)對(duì)象。同時(shí),在專利訴訟領(lǐng)域中,主要關(guān)注的技術(shù)集中于“觸摸屏幕”、“移動(dòng)數(shù)據(jù)傳輸”、“移動(dòng)數(shù)據(jù)獲取”和“面向?qū)ο蟮牟僮飨到y(tǒng)”四類,蘋果公司牢牢把持著觸摸屏幕技術(shù)領(lǐng)域的關(guān)鍵技術(shù),并在智能手機(jī)訴訟網(wǎng)絡(luò)中處于核心地位。由此,借助蘋果公司使用的專利策略,主要有基本專利戰(zhàn)略、專利轉(zhuǎn)讓策略及專利訴訟保護(hù)策略來(lái)窺探和預(yù)測(cè)未來(lái)智能手機(jī)的競(jìng)爭(zhēng)趨勢(shì),即以觸屏技術(shù)為代表的人機(jī)交互技術(shù)是研發(fā)重點(diǎn);提供智能平臺(tái)技術(shù)整合應(yīng)用服務(wù)成為研發(fā)熱點(diǎn);加強(qiáng)關(guān)鍵技術(shù)領(lǐng)域?qū)@w布局成為爭(zhēng)奪焦點(diǎn)。
[Abstract]:The technology competition and development speed of smart phones is becoming faster and faster. Patent litigation has become a common feature of mobile phone industry. Review history, this kind of litigation has tended to focus on the core technology of providing traditional mobile voice services such as radio transmission, network management and language compression technology. Recently, the field of smart phones From the perspective of the patent and the method of patent measurement and patent citation analysis, the competition state of the smart phone is analyzed and the future competition trend of smart phone is explored from the patent perspective and the method of patent citation analysis.
Based on the patent data in Derent's patent database, the article analyzes and describes the competitive state of the smart cell phone by using the technology of information visualization to analyze and describe the competitive state of the smart cell phone with the patent in the smart cell phone case collected and collated. The technology of information visualization is used to analyze and describe the competitive state of the smart phone. At the same time, six intelligent mobile phone fields are selected. Large cell phone manufacturers make a comparison of patent technology from two aspects of patent application and patented frequency, determine the position of smart phone enterprises in different technical fields. The patent citation network formed by patent of smart phone is used to further determine the focus of patent litigation in the field of smart phone. And core patents.
The results show that the number of patents in the field of smart phones is growing rapidly year by year, and the major patented owners are most of the main mobile phone manufacturers in the current smartphone market. There is a big gap between the number of patent applications and the frequency of patent cited among the smart phone companies, and the Apple Corp is patented though the Apple Corp is integrated. The number does not occupy the majority, but with high H index and high citation frequency, it has become an important object of technology competition in the field of smart phone. At the same time, in the field of patent litigation, the main technologies focus on "touch screen", "mobile data transmission", "mobile number acquirement" and "object oriented operating system", four types, The Apple Corp firmly holds key technologies in the field of touch screen technology and is at the core of the smart phone litigation network. Thus, with the help of the patent strategy used by Apple Corp, there are basic patent strategies, patent transfer strategies and patent litigation protection strategies to see and predict the future trend of smart phone competition, that is, The human-computer interaction technology represented by the touch screen technology is the focus of research and development, and the integration of application services of the intelligent platform technology has become the focus of research and development, and the focus of the competition is to strengthen the overall layout of the patent in the key technical fields.
