我國保健食品行業(yè)發(fā)展及監(jiān)管現(xiàn)狀、問題和對策研究

【摘要】:近年來,隨著經(jīng)濟(jì)社會(huì)的發(fā)展,人們保健需求和消費(fèi)能力逐步提高,促進(jìn)了保健食品市場的繁榮和產(chǎn)業(yè)的快速發(fā)展,保健食品的監(jiān)管體制和法律法規(guī)體系也逐步建立和健全,政府監(jiān)管工作不斷深入。與食品安全整體情況類似,保健食品安全形勢總體趨向穩(wěn)定,但也發(fā)生了一些安全事件,危害了消費(fèi)者的健康利益,降低了大眾的消費(fèi)信心,影響了產(chǎn)業(yè)快速發(fā)展的勢頭,給監(jiān)管工作帶來巨大挑戰(zhàn)。 本研究主要從加強(qiáng)政府監(jiān)管和促進(jìn)行業(yè)自律的角度出發(fā),以蜂膠類保健食品生產(chǎn)企業(yè)和藥店經(jīng)營保健食品為切入點(diǎn),討論如何對保健食品監(jiān)管的體制機(jī)制進(jìn)行完善,提高科學(xué)監(jiān)管和依法監(jiān)管能力,落實(shí)長效的監(jiān)管措施,形成高效的監(jiān)管體系。同時(shí),針對企業(yè)生產(chǎn)經(jīng)營過程中存在的問題,研究如何促進(jìn)生產(chǎn)經(jīng)營單位和人員提高保健食品安全意識(shí),切實(shí)落實(shí)企業(yè)是第一責(zé)任人的意識(shí),完善和落實(shí)內(nèi)部管理和自我約束機(jī)制,自覺自律進(jìn)行生產(chǎn)經(jīng)營活動(dòng),從源頭把好保健食品安全關(guān)。 本文通過問卷調(diào)查、實(shí)地調(diào)研、資料查閱、訪談等方法,對保健食品的監(jiān)管體系和產(chǎn)業(yè)發(fā)展的歷史及現(xiàn)狀進(jìn)行梳理,對存在的問題進(jìn)行深入剖析。結(jié)果顯示當(dāng)前保健食品的法律法規(guī)和標(biāo)準(zhǔn)體系還不盡完善,監(jiān)管責(zé)任尚未完全理順,技術(shù)支撐能力亟待加強(qiáng);生產(chǎn)經(jīng)營單位的保健食品基本知識(shí)匱乏,安全意識(shí)淡薄,依法生產(chǎn)經(jīng)營的能力亟待提升,甚至有部分業(yè)者為追求高額利潤,鋌而走險(xiǎn)、摻雜使假,違法生產(chǎn)經(jīng)營。 本文在分析借鑒國內(nèi)外保健食品監(jiān)管政策及實(shí)踐經(jīng)驗(yàn)基礎(chǔ)上,結(jié)合蜂膠類保健食品監(jiān)管特點(diǎn)及存在問題,在監(jiān)管層面提出加快法規(guī)體系建設(shè),理順監(jiān)管責(zé)任,加強(qiáng)技術(shù)保障能力,完善誠信體系等監(jiān)管建議;在企業(yè)管理層面,提出加強(qiáng)原料采購管理、落實(shí)良好生產(chǎn)規(guī)范、規(guī)范委托加工管理及規(guī)范經(jīng)營秩序的建議。
[Abstract]:In recent years, with the development of economy and society, people's health care demand and consumption ability have been improved step by step, which has promoted the prosperity of health food market and the rapid development of industry, and the supervision system and laws and regulations system of health food have been gradually established and perfected. Government supervision is constantly deepening. Similar to the overall situation of food safety, the overall situation of health food safety tends to be stable, but there have also been some safety incidents, which have jeopardized the health interests of consumers and reduced the consumer confidence of the public. Affected the rapid development of the industry momentum, regulatory work brings great challenges. From the angle of strengthening the government supervision and promoting the self-discipline of the industry, this study mainly discusses how to perfect the system and mechanism of health food supervision by taking propolis health food production enterprises and pharmacies as the starting point. To improve the ability of scientific supervision and supervision according to law, to implement long-term effective supervision measures, and to form an efficient regulatory system. At the same time, in view of the problems existing in the process of production and operation of enterprises, To study how to promote the production and management units and personnel to raise the awareness of health food safety, to conscientiously implement the awareness that enterprises are the first responsible persons, to perfect and implement internal management and self-restraint mechanisms, and to carry out production and management activities consciously and autonomously. Keep good health food safe from the source. Through questionnaire investigation, field investigation, data consultation, interview and other methods, this paper combs the history and present situation of the supervision system and industry development of health food. The results show that the current laws, regulations and standards system of health food are not perfect, the supervision responsibility has not been completely straightened out, and the technical support ability needs to be strengthened. The basic knowledge of health food in production and management units is scarce, the consciousness of safety is weak, and the ability of production and management according to law needs to be improved urgently. Even some of the operators, in order to pursue high profits, take risks, adulterate, and illegally produce and manage. Based on the analysis and reference of domestic and foreign health food supervision policy and practical experience, combined with the characteristics and problems of propolis health food supervision, this paper puts forward to accelerate the construction of regulatory system and straighten out the supervision responsibility at the regulatory level. In the aspect of enterprise management, the suggestions of strengthening the management of raw materials, carrying out good production standards, standardizing the management of entrusted processing and standardizing the management order are put forward.
