【摘要】：實用新型專利申請數(shù)量多年來保持持續(xù)穩(wěn)定增長,但是其專利質(zhì)量并沒有隨之提高。國內(nèi)外業(yè)界人士對我國實用新型專利質(zhì)量存在廣泛質(zhì)疑,如果再不采取有效措施提高實用新型專利質(zhì)量,無論是對創(chuàng)新主體,還是對實用新型專利制度自身必將帶來嚴(yán)重的傷害。通過分析發(fā)現(xiàn)我國實用新型專利質(zhì)量目前存在的主要問題:實用新型專利立法的不完善、實用新型審查制度的缺陷和專利資助政策的錯誤導(dǎo)向,進而從實用新型專利制度的頂層設(shè)計、專利審查制度的完善、專利激勵政策的正確制定和專利申請主體的法律規(guī)制四方面提出相應(yīng)提高我國實用新型專利質(zhì)量的對策。
[Abstract]:The number of patent applications for utility models has been growing steadily for many years, but the quality of patents has not improved. Domestic and foreign people in the industry have extensive doubts about the quality of utility model patents in China. If we do not take effective measures to improve the quality of utility model patents, no matter it is to the main body of innovation, Or to the utility model patent system itself will bring serious harm. Through the analysis, we find out the main problems existing in the quality of the utility model patent in our country: the imperfection of the patent legislation of the utility model, the defects of the examination system of the utility model and the wrong direction of the patent subsidy policy. Furthermore, the author puts forward the countermeasures to improve the quality of utility model patent in China from four aspects: the top design of utility model patent system, the perfection of patent examination system, the correct formulation of patent incentive policy and the legal regulation of patent application subject.
