【摘要】：對(duì)于近年來(lái)我國(guó)實(shí)用新型專利申請(qǐng)量持續(xù)增長(zhǎng)而專利有效量未同步增長(zhǎng),失效專利仍大量存在的問(wèn)題,文章基于浙江省失效專利信息的實(shí)證分析,得出失效實(shí)用新型專利大部分為非正常失效專利。經(jīng)分析影響該結(jié)果的根本原因?yàn)槭跈?quán)實(shí)用新型專利質(zhì)量不高,而影響其授權(quán)專利質(zhì)量的主要因素為實(shí)用新型專利審查制度。經(jīng)反思,相關(guān)法律法規(guī)對(duì)實(shí)用新型專利初步審查制度設(shè)置的不完善使得這類專利實(shí)際上不能被保證具備可專利性的要求。在此基礎(chǔ)上,文章比較借鑒幾個(gè)主要典型國(guó)家的實(shí)用新型審查制度并結(jié)合我國(guó)國(guó)情提出對(duì)應(yīng)制度的完善設(shè)想。
[Abstract]:On the basis of the empirical analysis of the failure patent information in Zhejiang Province , the author concludes that the main factors affecting the patent quality of the utility model are the patent examination system of the utility model . The analysis of the causes of the result is that the patent quality of the utility model is not high , and the main factors that affect the quality of the authorized patent are the utility model patent examination system . On the basis of this , the article compares the utility model examination system of several main typical countries and puts forward the perfect idea of corresponding system in combination with the national conditions of our country .
