【摘要】：正農(nóng)村集體土地罰沒地上物,是指在未經(jīng)批準或者采取欺騙手段騙取批準的情況下,占用符合土地利用總體規(guī)劃的農(nóng)村集體土地建設(shè)的建筑物和其他設(shè)施(簡稱"罰沒地上物")。城鄉(xiāng)接合部作為農(nóng)村向城市過渡的特殊區(qū)域,在巨大利益驅(qū)動下,違法占地問題比較突出,罰沒地上物體量較大。長期以來,由于法律制度不完善,城鄉(xiāng)接合部罰沒地上物管理存在較大盲區(qū)和監(jiān)管風(fēng)險,亟須依法規(guī)范,切實提高監(jiān)管績效和水平。罰沒地上物管理的基本情況
[Abstract]:In the case of rural collective land confiscated land, it refers to buildings and other facilities for the construction of rural collective land conforming to the overall planning of land use without approval or deception. The urban and rural joint part is a special area for the transition from the rural to the city. For a long time, because of the imperfect legal system, there is a big blind area and supervision risk in the management of the urban and rural joint Ministry. It is urgent to regulate the performance and level of supervision in accordance with the law.
