【摘要】：賄賂犯罪是受賄人、行賄人的共同犯罪;同時(shí)公共權(quán)力都設(shè)置了組織領(lǐng)導(dǎo)的連帶責(zé)任制度,公職人員受賄其領(lǐng)導(dǎo)應(yīng)負(fù)領(lǐng)導(dǎo)廉政責(zé)任。因此,作為腐敗現(xiàn)象的主要形式,公職人員收受賄賂事實(shí)上至少存在三個(gè)過(guò)錯(cuò)方,即受賄人、行賄人與領(lǐng)導(dǎo),是一種復(fù)合過(guò)錯(cuò)現(xiàn)象。因此,懲罰受賄者、行賄者和追究組織領(lǐng)導(dǎo)的連帶領(lǐng)導(dǎo)責(zé)任是我國(guó)法律法規(guī)的必然要求,但實(shí)踐中卻一直沒有得到有效實(shí)施,從而引發(fā)了反腐敗只懲罰受賄人的單一追責(zé)問(wèn)題。究其原因,一方面,法律和制度缺陷、監(jiān)督機(jī)關(guān)和司法機(jī)關(guān)的績(jī)效偏好等原因使得行賄犯罪得不到有效控制;另一方面,由于組織廉潔并非政府治理的優(yōu)先目標(biāo),以及問(wèn)責(zé)制度不健全等,領(lǐng)導(dǎo)的廉政責(zé)任難以受到追究。要解決腐敗現(xiàn)象的復(fù)合過(guò)錯(cuò)與單一追責(zé)的矛盾,應(yīng)該采取集約式反腐敗措施。集約式反腐敗是指運(yùn)用包括懲處受賄犯罪、打擊行賄犯罪以及追究領(lǐng)導(dǎo)的廉政責(zé)任等在內(nèi)的組合手段遏制和懲罰腐敗。集約式反腐敗是反腐敗法治化的必然要求,不僅體現(xiàn)有法必依、執(zhí)法必嚴(yán),也是廉政制度有效性的制度保障。
[Abstract]:The crime of bribery is the joint crime of the bribe-taker and the bribe-giver; at the same time, the public power has set up the joint and several liability system of the organization's leadership, and the public official's leadership should bear the responsibility of leading the clean government. Therefore, as the main form of corruption, public officials accept bribes in fact there are at least three fault parties, that is, bribery, bribery and leadership, is a compound fault phenomenon. Therefore, punishing the bribe-takers, bribe-givers and investigating the joint leadership responsibility of the leaders of the organization is the inevitable requirement of the laws and regulations of our country, but it has not been effectively implemented in practice, which has caused the single problem of punishing the bribe-takers only in the fight against corruption. On the one hand, the legal and institutional defects, the performance preferences of the supervisory and judicial organs, and so on, make bribery crimes out of effective control; on the other hand, because organizational integrity is not a priority goal of government governance, As well as the system of accountability is not perfect, the leadership of clean-government responsibility is difficult to be investigated. In order to solve the contradiction between complex fault of corruption and single responsibility, intensive anti-corruption measures should be taken. Intensive anti-corruption refers to the combination of punishing bribery crime, cracking down on bribery crime and investigating the leaders' clean government responsibility to curb and punish corruption. The intensive anti-corruption is the inevitable requirement of the anti-corruption rule by law. It not only embodies the law must abide by the law, enforce the law strictly, but also is the system guarantee of the validity of the clean government system.
