【摘要】：在構(gòu)建中國特色社會主義法律體系的時代語境中,"黨法"已由純粹的黨內(nèi)政策而蛻變?yōu)?軟法"。在這一演變邏輯中,需要同時具備前提性條件、內(nèi)生性條件和外生性條件�；谙到y(tǒng)論的研究視角,可以對"黨法"的整體運行方式、生成機制、形態(tài)機制、效力保障機制等多個子系統(tǒng)進行解構(gòu)。為了提升"黨法"的治理績效,需要"黨法"和"國家法"在國家治理現(xiàn)代化進程中的協(xié)同與共治。具體而言,應(yīng)分別構(gòu)建起"黨法"與"國家法"兩者之間的良性轉(zhuǎn)化機制及其"黨法"與"國家法"兩者之間的良性共存機制。
