【摘要】：近來遼寧、湖北等省(區(qū))嘗試開辦了土地承包經(jīng)營(yíng)權(quán)抵押貸款,為破解農(nóng)民貸款難題開辟了一條新途徑。但此舉也引來種種爭(zhēng)議,不少人因擔(dān)憂導(dǎo)致部分農(nóng)民失地,使農(nóng)民失去基本生活保障而堅(jiān)決反對(duì),同時(shí)在貸款實(shí)際操作中也面臨著缺少法律支持、土地價(jià)值評(píng)估難、土地處置變現(xiàn)難、貸款風(fēng)險(xiǎn)防控難等諸多障礙,土地承包經(jīng)營(yíng)權(quán)抵押貸款一直步履維艱,許多地區(qū)、許多銀行至今不敢涉足這一領(lǐng)域。為此,本文分析了開辦土地承包經(jīng)營(yíng)權(quán)抵押貸款的必要性和可行性,并針對(duì)貸款操作中遇到的問題,提出了解決對(duì)策。
[Abstract]:Recently, Liaoning, Hubei and other provinces have tried to set up mortgage loans for land contractual management rights, opening a new way to solve the problem of farmers' loans. However, the move has also led to various controversies. Many people are firmly opposed to the loss of some farmers' land and the loss of their basic living security because of their worries. At the same time, they also face a lack of legal support in the actual operation of the loan, and it is difficult to assess the value of the land. Land disposal is difficult to realize, loan risk is difficult to prevent and control and so on. Mortgage loan of land contract and management right has been difficult. In many areas, many banks dare not step into this field. Therefore, this paper analyzes the necessity and feasibility of setting up the mortgage loan of land contractual management right, and puts forward some countermeasures to solve the problems encountered in the operation of the loan.
