我國(guó)服務(wù)型政府的法制構(gòu)建

【摘要】:自福斯多夫在《當(dāng)成是服務(wù)主體的行政》中首次提出生存照顧理念以來(lái),世界各國(guó)不斷在服務(wù)型政府上進(jìn)行探索,“努力建設(shè)服務(wù)型政府”目前也成為我國(guó)政府的改革目標(biāo)。行政法是研究行政權(quán)力行使、政府行為規(guī)范和保障行政相對(duì)人合法權(quán)益的部門(mén)法學(xué),行政法對(duì)于服務(wù)型政府的構(gòu)建應(yīng)當(dāng)提供法學(xué)理論和實(shí)踐指導(dǎo)。行政法同時(shí)也不同于公共管理領(lǐng)域,,在行政法范疇下的服務(wù)型政府應(yīng)當(dāng)主要結(jié)合服務(wù)行政的法治背景,也應(yīng)當(dāng)思考政府應(yīng)當(dāng)如何擔(dān)當(dāng)公共服務(wù)的責(zé)任以及對(duì)于服務(wù)的接受者的權(quán)益的影響。 我國(guó)建設(shè)服務(wù)型政府以來(lái)所取得的一些進(jìn)步已經(jīng)能夠反應(yīng)在行政法的相關(guān)規(guī)定之中。隨著我國(guó)政治體制改革的不斷深化,服務(wù)理念將會(huì)更加深入政府的行政行為之中。于此同時(shí),我們也要辯證的看待服務(wù)型政府建設(shè)中出現(xiàn)的問(wèn)題以及可能侵害公民合法權(quán)益的一些傾向。只有總結(jié)問(wèn)題才能更好的進(jìn)行法律完善。 體現(xiàn)建設(shè)服務(wù)型政府取向的行政法,不僅是對(duì)當(dāng)前政府建設(shè)和改革成果的鞏固,也是對(duì)政府模式轉(zhuǎn)變的進(jìn)一步塑造。服務(wù)型政府的建設(shè)需要行政法的支撐。行政法基本原則特別是依法行政原則需要適應(yīng)服務(wù)型政府的需求。作為政府主要職能的服務(wù)職能,在啟動(dòng)環(huán)節(jié),需要明確提供服務(wù)的范圍,也要明確政府與民間、社會(huì)的界限。在運(yùn)行環(huán)節(jié),以公眾需求為導(dǎo)向的政府需要完善公民參與機(jī)制,完善以電子政府為代表的行政信息公開(kāi)和民意表達(dá)渠道。在修補(bǔ)環(huán)節(jié),應(yīng)當(dāng)建立完善的行政責(zé)任機(jī)制。
[Abstract]:Since Fosdorf put forward the concept of survival care for the first time in Administration as the subject of Service, countries all over the world have been exploring the service-oriented government, and "striving to build a service-oriented government" has become the reform goal of our government at present. Administrative law is a departmental law that studies the exercise of administrative power, the norms of government behavior and the protection of the legitimate rights and interests of the administrative counterpart. Administrative law should provide legal theory and practical guidance for the construction of service-oriented government. At the same time, administrative law is different from the field of public management. Under the category of administrative law, the service-oriented government should mainly combine the legal background of service administration, and should also think about how the government should bear the responsibility of public service and its influence on the rights and interests of service recipients. Some progress made since the construction of service-oriented government in China has been reflected in the relevant provisions of administrative law. With the deepening of the reform of political system in our country, the service concept will go deeper into the administrative behavior of the government. At the same time, we should also dialectically look at the problems in the construction of service-oriented government and some tendencies that may infringe on the legitimate rights and interests of citizens. Only by summing up the problems can we improve the law better. The administrative law, which embodies the orientation of the construction service-oriented government, is not only the consolidation of the achievements of the current government construction and reform, but also the further shaping of the transformation of the government model. The construction of service-oriented government needs the support of administrative law. The basic principles of administrative law, especially the principle of administration according to law, need to meet the needs of service-oriented government. As the main function of the government, in the start-up link, it is necessary to clarify the scope of providing services, as well as the boundary between the government and the people and society. In the operation link, the government guided by public demand needs to improve the mechanism of citizen participation and the channel of administrative information disclosure and public opinion expression represented by e-government. In the repair link, we should establish a perfect administrative responsibility mechanism.
