行政約談的法律認(rèn)定

【摘要】:隨著全球化與信息化的發(fā)展,社會分工日漸精細(xì)化、復(fù)雜化,給社會治理帶來了前所未有的挑戰(zhàn)。與之相悖,“傳送帶式”的傳統(tǒng)行政管理模式之積弊日漸凸顯,不再能滿足社會發(fā)展的需要。歷經(jīng)傳統(tǒng)公共行政理論、新公共管理理論、新公共服務(wù)理論等理論的變遷,行政約談作為非正式執(zhí)法方式的代表,成為治國理政的新攻略。通過對相關(guān)文件的梳理,不難發(fā)現(xiàn),行政約談旨在通過協(xié)商對話的方式引導(dǎo)行政相對人改正明顯不當(dāng)或違法性難以界定的行為,能有效地規(guī)避官民沖突,節(jié)約執(zhí)法成本,達(dá)到“力挽狂瀾”的效果。然而,作為新興事務(wù),對行政約談進(jìn)行正本清源絕非易事。目前,關(guān)于行政約談性質(zhì)認(rèn)定的觀點(diǎn)共有六種,有些人試圖通過創(chuàng)建新理論對其進(jìn)行法律認(rèn)定。殊不知,新理論的構(gòu)建“牽一發(fā)而動全身”,純粹為了學(xué)術(shù)創(chuàng)新而打亂成熟的行政法理論體系,是理論研究中的一種方向性錯誤。因此,厘清行政約談的性質(zhì),刻不容緩,實(shí)為必要。本文共包括四個部分。第一章,旨在闡述行政約談的概念和產(chǎn)生背景,通過對相關(guān)規(guī)范性文件的分析概括其基本含義,并對其產(chǎn)生的理論背景如新公共管理理論、新公共服務(wù)理論等進(jìn)行梳理。第二章對有關(guān)行政約談的法律和一些部門規(guī)章的規(guī)定進(jìn)行了分析,對行政約談的適用情形進(jìn)行了概括總結(jié)。第三章,首先對有關(guān)行政約談性質(zhì)認(rèn)定的觀點(diǎn)進(jìn)行了概括總結(jié),然后對這些觀點(diǎn)進(jìn)行評價(jià),并在此基礎(chǔ)上闡述自己的觀點(diǎn),將行政約談?wù)J定為行政指導(dǎo)的一種方式。第四章,以行政約談紛繁復(fù)雜的實(shí)踐亂象為立論背景,透過現(xiàn)象看本質(zhì),將行政約談與行政指導(dǎo)、責(zé)令改正、警告進(jìn)行對比分析,并對它們之間的關(guān)系處理提出一己之見。
[Abstract]:With the development of globalization and information, the social division of labor becomes more and more sophisticated, which brings unprecedented challenges to social governance. Contrary to this, the traditional administration mode of "conveyor belt" is becoming more and more obvious and can no longer meet the needs of social development. After the changes of traditional public administration theory, new public management theory and new public service theory, administrative interview, as the representative of informal law enforcement, has become a new strategy of governance. Through combing the relevant documents, it is not difficult to find that the administrative interview aims to guide the administrative counterpart to correct the obviously improper or illegal behavior by means of consultation and dialogue, which can effectively avoid the conflicts between the officials and the people, and save the cost of enforcing the law. Achieve the effect of "trying to turn the tide". However, as a new business, administrative interviews are no easy task. At present, there are six views on the nature of administrative interview, some people try to establish a new theory to determine the nature of administrative interviews. However, it is a kind of directional mistake in the theoretical research that the construction of the new theory "moves the whole body with one hair" and disrupts the mature administrative law theory system purely for the sake of academic innovation. Therefore, it is urgent and necessary to clarify the nature of administrative interview. This paper consists of four parts. The first chapter is aimed at explaining the concept and background of administrative interview, summarizing its basic meaning through the analysis of relevant normative documents, and combing its theoretical background such as the theory of new public management and the theory of new public service. The second chapter analyzes the laws and regulations of administrative interview and summarizes the application of administrative interview. In the third chapter, the author summarizes the views about the nature of administrative interview, and then evaluates these views, and on the basis of this, expounds his own views, and regards the administrative interview as a way of administrative guidance. The fourth chapter takes the complicated practice of administrative interview as the theoretical background, through the phenomenon to see the essence, administrative interview and administrative guidance, order correction, warning for comparative analysis, and put forward their own views on the handling of the relationship between them.
