建設(shè)工程項(xiàng)目行政審批制度改革研究

【摘要】:政府隨著形勢(shì)發(fā)展,為加強(qiáng)對(duì)建設(shè)工程的管理不斷地出臺(tái)和加強(qiáng)各類審批程序,也有不同時(shí)期各種簡(jiǎn)政放權(quán)改革的嘗試。但現(xiàn)狀是越改越復(fù)雜、越改越浪費(fèi),究其原因就在于建設(shè)工程項(xiàng)目行政審批的實(shí)施和改革沒有與轉(zhuǎn)變政府職能和其他配套改革結(jié)合起來統(tǒng)籌推進(jìn)。本文從政府職能的轉(zhuǎn)變是建設(shè)工程項(xiàng)目行政審批改革的本源,而建設(shè)工程項(xiàng)目行政審批制度又是政府職能轉(zhuǎn)變的切入點(diǎn)這一角度,從以下三個(gè)部分進(jìn)行論述: 第一部分:建設(shè)工程項(xiàng)目行政審批制度的基本理論。建設(shè)工程行政審批屬于行政審批的一類,建設(shè)工程審批制度是工程參建各方在項(xiàng)目實(shí)施的不同階段按照法律法規(guī)要求,向政府管理工程項(xiàng)目的職能部門提起審批申請(qǐng),政府職能部門因應(yīng)申請(qǐng)進(jìn)行審查批復(fù)等一系列行為規(guī)程和準(zhǔn)則的總稱,建設(shè)工程審批的性質(zhì)是“解禁”。建設(shè)工程項(xiàng)目實(shí)施行政審批是資源合理配置的必然要求,是實(shí)現(xiàn)政府對(duì)公共安全保障的需要。建設(shè)工程審批制度設(shè)置理念和原則主要包括服務(wù)行政理念、責(zé)任政府理念、正當(dāng)性程序原則、公眾參與原則。 第二部分:建設(shè)工程項(xiàng)目行政審批制度改革必要性。探討建設(shè)工程項(xiàng)目審批制度改革的歷程、現(xiàn)狀和存在問題。現(xiàn)在工程建設(shè)項(xiàng)目審批流程可分為立項(xiàng)審批、用地審批、建設(shè)方案審批、招標(biāo)審批和施工報(bào)建審批五個(gè)階段;具是沿用互為前置,層層審批,簡(jiǎn)單地不斷增加審批或備案來應(yīng)對(duì)日益復(fù)雜的管理局面,現(xiàn)在建設(shè)工程項(xiàng)目行政審批手續(xù)的繁瑣程度已達(dá)到高峰。建筑工程項(xiàng)目行政審批制度的改革不僅在宏觀上事關(guān)國家經(jīng)濟(jì)發(fā)展和政府職能的轉(zhuǎn)變,同時(shí)在微觀上對(duì)經(jīng)濟(jì)活動(dòng)的影響巨大,工程建設(shè)項(xiàng)目審批制度新一輪的改革已迫在眉睫。 第三部分:建設(shè)工程項(xiàng)目審批制度改革的構(gòu)想。歷次建設(shè)工程項(xiàng)目行政審批改革關(guān)注的主要是審批事項(xiàng)的撤銷與減少的數(shù)量,審批流程和時(shí)間的壓縮等屬于物理組合的變化,并沒有從根本上去思考建設(shè)工程行政審批的價(jià)值。改革必須從審批價(jià)值的實(shí)現(xiàn)來指導(dǎo)建設(shè)工程項(xiàng)目行政審批改革才能根本上回答了為什么改,怎么改,改得好不好這些關(guān)鍵問題。建設(shè)工程行政審批制度改革有兩種模式,一種是從中央層面設(shè)置全國統(tǒng)一要求改革的模式,另外一種是先從局部地方先行先試開始繼而推動(dòng)全國性改革的模式,兩種模式各有優(yōu)缺點(diǎn)。根據(jù)我國的實(shí)際國情,地方探索型的改革更容易找到突破口,,特別可充分運(yùn)用特區(qū)立法的立法優(yōu)勢(shì)結(jié)合中央政府給予的政策優(yōu)勢(shì)先行先試,探索改革,積累經(jīng)驗(yàn)為全國的改革提供參考。以政府與市場(chǎng)邊界的理論再造審批流程,以政府服務(wù)理念為原則,采用互聯(lián)網(wǎng)先進(jìn)技術(shù)優(yōu)化審批的運(yùn)行機(jī)制。
[Abstract]:With the development of the situation, in order to strengthen the management of construction projects and strengthen the examination and approval procedures, there are also various attempts to reform the decentralization of government in different periods. However, the present situation is that the reform becomes more and more complex and more wasteful. The reason lies in the fact that the implementation and reform of administrative examination and approval of construction project has not been integrated with the transformation of government functions and other supporting reforms. From the point of view that the transformation of government functions is the source of the reform of administrative examination and approval of construction projects, and the system of administrative examination and approval of construction projects is the starting point of the transformation of government functions, From the following three parts: the first part: the basic theory of construction project administrative examination and approval system. The administrative examination and approval of construction projects belongs to the category of administrative examination and approval. The system of examination and approval of construction projects is that the parties involved in the construction projects file applications for examination and approval to the functional departments of the government in charge of the projects in accordance with the requirements of laws and regulations at different stages of the implementation of the projects. The general name of a series of codes of conduct and codes of conduct, such as examination and approval of government departments in response to applications, is that the nature of construction project approval is "lifting the ban". The implementation of administrative examination and approval of construction projects is the inevitable requirement of rational allocation of resources and the need of the government to realize the public security. The idea and principle of construction project examination and approval system mainly include service administration idea, responsibility government idea, legitimate procedure principle and public participation principle. The second part: the necessity of reform of administrative examination and approval system of construction project. This paper probes into the course, present situation and existing problems of the reform of the examination and approval system for construction projects. At present, the approval process of construction projects can be divided into five stages: project approval, land use approval, construction project approval, tender approval and construction approval. Basically still using each other as the leading, layers of examination and approval, simply increasing the approval or record to cope with the increasingly complex management situation, now the construction project administrative examination and approval procedures have reached a peak. The reform of administrative examination and approval system of construction project is not only related to the national economic development and the transformation of government functions, but also has a great impact on economic activities in the micro level. A new round of reform of the examination and approval system of construction project is imminent. The third part: the conception of the reform of the examination and approval system of construction project. The previous reform of administrative examination and approval of construction project is mainly concerned with the amount of revocation and reduction of the items of approval, the compression of approval process and time is the change of physical combination, and the value of administrative examination and approval of construction project has not been considered fundamentally. The reform must guide the reform of administrative examination and approval of construction project from the realization of the value of examination and approval in order to answer the key questions of why, how and whether the reform is good or not. There are two models for the reform of the administrative examination and approval system for construction projects. One is to set up a national unified model for reform at the central level, and the other is to first try out the local areas first and then promote the national reform. The two models have their own advantages and disadvantages. According to the actual situation of our country, it is easier to find a breakthrough in local exploratory reform. In particular, we can make full use of the legislative advantages of the special zone legislation and combine the policy advantages given by the central government to first try and explore the reform. Accumulation of experience to provide a reference for national reform. Based on the theory of the boundary between government and market, this paper reconstructs the approval process, takes the concept of government service as the principle, and optimizes the operation mechanism of examination and approval by using the advanced technology of the Internet.
