論公共文化服務(wù)的基本性

【摘要】：公共文化服務(wù)的基本性是指基于一國的經(jīng)濟(jì)社會(huì)發(fā)展水平和公民一定的文化共識(shí),由政府主導(dǎo)提供的面向全體社會(huì)成員以保障公民基本文化生存和發(fā)展權(quán)利,滿足公民基本文化需求的基本社會(huì)文化條件。公共文化服務(wù)的基本性源于公共文化產(chǎn)品的特殊性和新公共管理"有限政府服務(wù)"理論。作為基本權(quán)利的文化權(quán)利,是憲法和法律確認(rèn)和規(guī)定的以國家強(qiáng)制力保障實(shí)施的個(gè)人在社會(huì)文化等方面不可缺少的權(quán)利。公民基本文化權(quán)利是公共文化服務(wù)的基本性的核心理念。確定公共文化服務(wù)基本性的邊界應(yīng)堅(jiān)持"�；�"、"廣覆蓋"、"解急需"和"量力行"的原則。在操作層面有兩個(gè)標(biāo)準(zhǔn):一是國家憲法和法律有關(guān)基本文化權(quán)利的規(guī)定;二是國家經(jīng)濟(jì)社會(huì)發(fā)展水平和財(cái)政狀況。
[Abstract]:The basic nature of public cultural service refers to the protection of the citizens' right to basic cultural survival and development based on the level of economic and social development of a country and a certain level of cultural consensus of the citizens, which is provided by the government and directed to all members of society. Basic social and cultural conditions to meet the basic cultural needs of citizens. The basic nature of public cultural service originates from the particularity of public cultural products and the theory of "limited government service" in new public management. As a basic right, the cultural right is recognized and stipulated by the Constitution and the law, which is an indispensable right in the social and cultural aspects, which is guaranteed by the national coercive force. Citizen's basic cultural right is the core idea of public cultural service. To determine the basic nature of public cultural services, we should adhere to the principles of "preserving the basic", "covering widely", "solving the urgent needs" and "carrying out the measures". At the operational level, there are two standards: one is the provisions of the national constitution and the law on basic cultural rights, the other is the level of national economic and social development and the financial situation.
