我國海上搜救社會力量補(bǔ)償機(jī)制研究

【摘要】：社會救助力量在我國的海上搜救工作中發(fā)揮了十分重要的作用,在參與了搜救行動的同時,自身也由于延誤船期、燃油漲價、材料消耗以及人員工資的支出等,造成了一定的經(jīng)濟(jì)損失。針對目前我國海上搜救需要社會力量參與以及社會力量補(bǔ)償范圍過小、補(bǔ)償手段單一以及補(bǔ)償額度過低的事實,大量的社會參與海上救助行動后自己的利益得不到合理的補(bǔ)償,實現(xiàn)政府提供公平公正的海上搜救的公共服務(wù)道路上,建立符合我國國情的海上社會力量補(bǔ)償機(jī)制顯得尤為重要,鑒于此,在公共管理經(jīng)濟(jì)人理論基礎(chǔ)上,運用統(tǒng)計分析法,從憲法保護(hù)私人財產(chǎn)的立法精神出發(fā),國家有償征用理論,提出要保護(hù)海上搜救社會力量的合法權(quán)益,引用國防征用民用運力經(jīng)濟(jì)補(bǔ)償原理,借鑒國外部分國家的補(bǔ)償和獎勵機(jī)制和經(jīng)驗,提出建立我國海上搜救社會力量補(bǔ)償機(jī)制,通過擴(kuò)大補(bǔ)償范圍,推出多種補(bǔ)償辦法,提高補(bǔ)償力度等方法,全方位保護(hù)漁民、船員、漁船、商船、經(jīng)營公司、飛行員、志愿者等社會救助力量的利益,提出給個人頒發(fā)榮譽(yù)勛章、證書和發(fā)放撫恤金、幫助申報見義勇為獎金和評選海上搜救特別勇敢獎等措施；給漁業(yè)或者商業(yè)經(jīng)營公司頒發(fā)牌匾、建立救助檔案、推行綠色通道、直接和間接減免稅費包括漁業(yè)資源稅、營業(yè)稅、所得稅、車船使用稅、城建稅、教育附加費、印花稅等和在自由裁量的情況下采取保護(hù)政策等措施,破解當(dāng)前我國海上搜救社會力量補(bǔ)償?shù)碾y題,確保社會力量得到公正公平的補(bǔ)償,鼓勵和保護(hù)社會力量參與海上搜救的積極性,促進(jìn)我國海上搜救的可持續(xù)性發(fā)展。
[Abstract]:Social rescue forces have played a very important role in the search and rescue work at sea in our country. While participating in the search and rescue operation, they also participated in the search and rescue operation because of the delay in shipping time, the increase in fuel prices, the consumption of materials and the expenditure of personnel wages, etc. Caused certain economic losses. In view of the fact that at present China's maritime search and rescue needs the participation of social forces and the small range of social power compensation, the compensation means are single and the compensation amount is too low, a large number of society can not get reasonable compensation for their own interests after participating in the salvage operations at sea. In order to realize the public service of the government to provide fair and just maritime search and rescue, it is very important to establish the compensation mechanism of the maritime social power in accordance with the national conditions of our country. In view of this, on the basis of the theory of economic man in public administration, the statistical analysis method is used. Proceeding from the legislative spirit of the Constitution to protect private property and the theory of state compensation for expropriation, it is proposed to protect the legitimate rights and interests of maritime search and rescue social forces, and to quote the principle of economic compensation for civil transportation capacity requisitioned by national defense. Drawing lessons from the compensation and reward mechanism and experience of some foreign countries, this paper puts forward the establishment of the compensation mechanism for the social forces of maritime search and rescue in our country. By expanding the compensation scope, introducing various compensation methods and increasing the compensation intensity, the fishermen can be protected in all directions. Members of the crew, fishing boats, merchant shipping, operating companies, pilots, volunteers and other social aid forces have offered to award medals of honor, certificates and pensions to individuals. To help declare rewards for righteous deeds and to select special bravery awards for maritime search and rescue; to issue plaques to fishery or commercial business companies, to establish rescue files, to implement green channels, and to reduce and reduce taxes and fees directly and indirectly, including fishery resources tax, business tax, etc. Income tax, vehicle and vessel use tax, urban construction tax, education surcharge, stamp duty, and other measures to solve the current problem of compensation for maritime search and rescue social forces in China, To ensure that social forces receive fair and equitable compensation, to encourage and protect the enthusiasm of social forces to participate in maritime search and rescue, and to promote the sustainable development of maritime search and rescue in China.
