公益性投訴舉報類行政案件的訴訟救濟問題探究

【摘要】:隨著公民權(quán)利意識的不斷增強和參與行政活動的積極性不斷高漲,由公民投訴舉報引發(fā)的諸多問題開始不斷困擾著行政復(fù)議工作者和司法裁判者。公益性投訴舉報人能否以其投訴舉報權(quán)或公共利益受侵害為由提起行政訴訟,是目前最具爭議的問題。公民是否享有投訴舉報權(quán)及所訴行政行為的種類差異直接影響此類案件可否納入司法監(jiān)督體系。對行政機關(guān)不予答復(fù)等不作為不服的,公益性投訴舉報人須享有法律規(guī)范明確賦予的投訴舉報權(quán)才具備原告資格,此種情形下的行政不作為屬于行政訴訟受案范圍;對行政機關(guān)答復(fù)內(nèi)容不服的,無論是否享有明確的投訴舉報權(quán),都因與處理結(jié)果不具有利害關(guān)系而不具備原告資格,除非答復(fù)內(nèi)容侵害了其享有的法定獲得獎勵權(quán)。
[Abstract]:With the increasing awareness of civil rights and the increasing enthusiasm of participating in administrative activities, many problems caused by citizen complaints and reports have been perplexing administrative reconsideration workers and judicial adjudicators. It is the most controversial issue whether the public welfare complaint whistleblower can file an administrative lawsuit on the basis of his right to complain or the infringement of the public interest. Whether citizens enjoy the right to complain and report and the variety of administrative actions directly affect whether such cases can be brought into the judicial supervision system. If the administrative authorities refuse to reply and other inaction, the public welfare complaint whistleblower must enjoy the right of complaint and report, which is clearly conferred by the legal norms, in order to have the plaintiff's qualification, the administrative omission in this case belongs to the scope of accepting the case in the administrative proceedings; Those who refuse to accept the content of the administrative organ's reply, whether or not they have a clear right to complain and report, do not have the plaintiff's qualification because they are not interested in the result, unless the content of the reply infringes on their legal right to receive an award.
