縣級(jí)政府信息公開制度建設(shè)中存在的問題及對(duì)策研究

【摘要】:上世紀(jì)末80年代開始,我國(guó)為適應(yīng)改革開放和社會(huì)主義的發(fā)展要求,不斷推進(jìn)和深化行政體制改革。改革的重要目標(biāo)是通過政府信息的公布來實(shí)現(xiàn)行政的透明化和彰顯政府的服務(wù)性。在社會(huì)信息化程度越來越高的當(dāng)下,政府的信息公開是社會(huì)和經(jīng)濟(jì)活動(dòng)進(jìn)行和發(fā)展的必然需要,是保障公民知情權(quán)的必要手段,是構(gòu)建服務(wù)型政府的內(nèi)在要求。隨著科學(xué)文化的迅猛發(fā)展,公民對(duì)民主政治和民主權(quán)利的要求進(jìn)一步升級(jí),政府信息公開收到了更為廣泛的關(guān)注。在我國(guó)進(jìn)行政府信息公開的實(shí)踐中,縣級(jí)政府往往是各項(xiàng)措施是點(diǎn)和最先試運(yùn)行的地方,但一旦正式運(yùn)行,縣級(jí)政府就會(huì)成為各級(jí)政府中的落后者。雖然存在經(jīng)濟(jì)條件、人才限制等方面的制約,但這種現(xiàn)象仍然值得我們?nèi)シ此。本文也就此展開論述。作為提高政府公信力的重要手段,,政府信息公開制度具有堅(jiān)實(shí)的理論基礎(chǔ)和法律基礎(chǔ)。自《中華人民共和國(guó)政府信息公開條例》頒布并實(shí)施以來,全國(guó)各地政府信息公開工作正式進(jìn)入運(yùn)行,并在一定程度收到了成效。由于我國(guó)發(fā)展政府信息公開起步比較晚,雖然有利之處是可以更多的借鑒其他發(fā)達(dá)國(guó)家的經(jīng)驗(yàn),避免重復(fù)走其他國(guó)家走過的彎路。但不可否認(rèn)的是,由于落后封閉思想的歷史傳承性等原因,我國(guó)的政府信息公開建設(shè)走的并不平坦。為了研究取證的方便,本文以縣級(jí)政府為視角,研究政府信息公開制度的建設(shè),縱觀國(guó)內(nèi)外對(duì)于政府信息公開的研究分析,結(jié)合本人研究生階段公共管理專業(yè)所學(xué)的社會(huì)科學(xué)研究方法中的實(shí)證分析法,文獻(xiàn)分析法等方法,對(duì)我國(guó)縣級(jí)政府信息公開的現(xiàn)狀和政府信息公開的必要性和可行性進(jìn)行分析,試圖指出當(dāng)下縣級(jí)政府信息公開制度建設(shè)中存在的問題,并借鑒國(guó)內(nèi)外寶貴經(jīng)驗(yàn),針對(duì)問題提出相應(yīng)的解決方案,解決立法,和權(quán)利意識(shí)等方面的問題,協(xié)調(diào)權(quán)利的內(nèi)外部監(jiān)督,增強(qiáng)政府公信力,使政府更能充分發(fā)揮服務(wù)于民的作用。
[Abstract]:Since the late 1980s, in order to meet the requirements of reform and opening up and socialist development, China has continuously promoted and deepened the reform of administrative system. The important goal of the reform is to realize the transparency of administration and the service of the government through the publication of government information. At a time when the level of social information is becoming more and more high, government information disclosure is the inevitable need of social and economic activities and development, is a necessary means to protect citizens' right to know, and is the inherent requirement of building a service-oriented government. With the rapid development of science and culture, citizens' demand for democratic politics and democratic rights has been further upgraded, and the publicity of government information has received more and more attention. In the practice of publicizing government information in our country, the county government is often the place where every measure is the first to run, but once it is officially operated, the county government will become the laggard among the governments at all levels. Although there are economic conditions, talent restrictions and other aspects of constraints, but this phenomenon is still worthy of our reflection. This paper also discusses this. As an important means to improve the credibility of the government, the open system of government information has a solid theoretical and legal basis. Since the promulgation and implementation of the regulations of the people's Republic of China on the publicity of Government Information, the work of government information disclosure in various parts of the country has been officially put into operation, and to a certain extent has received results. As the development of government information in China started relatively late, although the advantage is that we can learn more from the experience of other developed countries, and avoid repeating the detours that other countries have taken. However, it is undeniable that due to the historical inheritance of backward closed thoughts, the construction of government information publicity in China is not smooth. In order to study the convenience of obtaining evidence, this paper studies the construction of government information disclosure system from the perspective of county-level government, and makes a general survey of the research and analysis of government information disclosure at home and abroad. Combining with the methods of empirical analysis and literature analysis, this paper analyzes the present situation of county level government information disclosure and the necessity and feasibility of government information disclosure. This paper attempts to point out the problems existing in the construction of the county level government information disclosure system, and draw lessons from valuable experience at home and abroad, and put forward corresponding solutions to the problems, such as legislation, rights awareness, and so on. Coordinate the internal and external supervision of the right, strengthen the credibility of the government, and make the government fully play the role of serving the people.
