新公共管理視角下廈漳泉區(qū)域砂船的海事監(jiān)管研究

【摘要】:目前廈漳泉水域有大量的砂船在營運,由于種種歷史原因,其中大量的砂船存在船舶技術(shù)狀態(tài)總體上比較差、未取得船檢證書、超航區(qū)使用等,技術(shù)狀態(tài)滿足不了現(xiàn)行船舶法規(guī)和規(guī)范的要求,造成了大量的“三無”船舶的存在。也由于這些船舶沒有證書,再加上船東、船員的素質(zhì)低,配員也不足,造成海事日常管理中無法簽證、無法安檢等,而砂船水上交通安全事故時有發(fā)生,對本水域水上交通公共安全造成極大的威脅,給海事海上公共安全管理帶來很大的壓力,也對海事如何實施海上公共安全管理帶來新的挑戰(zhàn)。作為主管機關(guān)的海事部門經(jīng)過多年的多方面加強對砂船的監(jiān)管并取得了一定的效果,但是傳統(tǒng)的海事監(jiān)管模式仍無法從根源上解決砂船存在的歷史遺留問題。為解決廈漳泉區(qū)域砂船監(jiān)管難題,本研究采取理論研究、走訪調(diào)查、資料收集以及分析總結(jié)相結(jié)合的技術(shù)路線進行研究。首先,重點分析了國外海事監(jiān)管的現(xiàn)狀,以及國內(nèi)海事管理機構(gòu)對砂船監(jiān)管現(xiàn)狀,在吸取國內(nèi)外海事監(jiān)管的經(jīng)驗基礎(chǔ)上,提出了以新公共管理理論為基礎(chǔ)的廈漳泉區(qū)域砂船監(jiān)管研究方法;其次,通過相關(guān)資料收集和整理,分析了廈漳泉區(qū)域砂船的現(xiàn)狀及其存在的主要問題;最后,針對廈漳泉區(qū)域砂船存在的主要問題,提出了以新公共管理理論為基礎(chǔ)的海事監(jiān)管責任和服務(wù)并重的廈漳泉水域砂船監(jiān)管措施,以期為廈漳泉區(qū)域砂船監(jiān)管提供有益的參考。
[Abstract]:At present, a large number of sand vessels are in operation in the Xia-Zhangquan waters. Due to various historical reasons, a large number of sand vessels are in a relatively poor technical state on the whole. They have not obtained ship inspection certificates and are used in excess of navigation areas, etc. The technical condition can not meet the requirements of the current ship regulations and codes, resulting in the existence of a large number of "three noes" ships. It is also because these vessels do not have certificates, coupled with the low quality of the shipowners and crew members, and the shortage of personnel, resulting in the inability to obtain visas and security checks in the day-to-day management of maritime affairs, and the fact that maritime traffic safety accidents on sand vessels occur from time to time. It poses a great threat to the public safety of maritime traffic in this water area, brings great pressure to maritime public safety management, and also brings new challenges to maritime public safety management. As a competent authority, the maritime department has strengthened the supervision of sand ships in many aspects for many years and achieved certain results. However, the traditional maritime supervision mode still can not solve the historical problems existing in sand ships from the root. In order to solve the problem of sand ship supervision in Xia-Zhangquan area, this study adopts theoretical research, visiting investigation, data collection and technical route combining analysis and summary. First of all, it analyzes the current situation of maritime supervision abroad, and the current situation of domestic maritime regulatory agencies on sand ships, on the basis of absorbing the experience of maritime supervision at home and abroad. Based on the new public management theory, this paper puts forward the research method of sand ship supervision in Xia-Zhangquan area. Secondly, through the collection and arrangement of relevant data, the paper analyzes the present situation and main problems of sand ship in Xia-Zhangquan area. Aiming at the main problems of sand ship in Xia-Zhangquan area, this paper puts forward the supervision measures of sand ship in Xia-Zhangquan area, which is based on the new public management theory and pays equal attention to the responsibility and service of maritime supervision, in order to provide a useful reference for the supervision of sand ship in Xia-Zhangquan area.
